منشور حقوق شهروندی: ارزیابی نقادانه‌ از منظر میان‌رشته‌ای

مقولهٔ شهروندی و حقوق و تکالیف مترتب بر آن در کانون مبانی شکل‌گیری دولت‌های مدرن قرار دارد و بر چگونگی ساختارهای حقوقی و فرایندهای تصمیم‌گیری در نظام‌های مردم‌سالار تاثیری بس گسترده دارد. در این راستا، منشور حقوق شهروندی، که دستاورد تلاش‌های دولت یازدهم بوده است، با هدف تاکید، تبیین و تبویب نظام حق و تکلیف شهروندان جمهوری اسلامی ایران منتشر و به‌ ادارات و سازمان‌های دولتی ابلاغ شد. هدف این نوشتار این است که متن منشور را با بهره‌گیری از رهیافتی میان‌رشته‌ای مورد ارزیابی نقادانه قرار دهد و از این طریق، مزایا و کاستی‌های آن را به‌منظور بهره‌برداری در ویراست‌های بعدی آن نشان داده ‌شود. متن منشور به‌عنوان یک سند حقوقی منتشر شده است، اما مباحث بنیادین آن در حوزهٔ اندیشهٔ سیاسی مطرح شده و می‌شود. بنابراین، پس از مرور سریع تاریخ تکوین و مبادی فلسفی حق شهروندی در بخش اول، با بهره‌گیری از مطالعات انجام‌یافته در اندیشهٔ سیاسی، تبیین سه‌دیدگاه اصلی دربارهٔ اساس حقوق شهروندی (لیبرال، جامعه‌گرا و جمهوریت‌گرا) در بخش دوم صورت گرفته‌ است. در بخش سوم، با بهره‌گیری از مباحث ارایه شده در بخش‌های اول و دوم نوشتار، ارزیابی نقادانهٔ منشور حقوق شهروندی جمهوری اسلامی ایران انجام گرفته است که شامل برخی پیشنهادات برای تکامل و اصلاح آن نیز هست.

assessing the charter on citizens’ rights: a multi-disciplinary critique

the idea of citizenship and the related rights and duties is at the heart of the basics of the modern state and its formation, with its very influential role on the legal structures and processes of decisionmaking of democratic regimes. the charter on citizens’ rights, published by the government of the islamic republic of iran, confirms and clarifies the rights and duties of the citizens, and notified them to all governmental offices. here i critically evaluate the contents of the charter by using a multidisciplinary approach, showing its strengths and weaknesses for further revisions. in what follows, i offer a review of the history of the development of the idea of citizenship and its philosophical foundations in the first section. the second section is concerned with presenting very briefly the three main approaches to citizenship, i.e. the liberal, communitarian and republican, and their ethical, political, philosophical and sociological dimensions. the final section focused on the evaluation of some of the main themes of the charter, following by some suggestions for further consideration.
