چکیده
|
موازین کیفری حقوق هسته‌ای در چارچوب ساختار کیفری به عنوان گروهی از قواعد که در سطح ملی، منطقه ای یا بین‌المللی به کار بسته می‌شوند تا شیوه های مرتبط با انرژی هسته ای یا رادیواکتیو را جرم‌انگاری کنند یا دولت‌ها ملزم به جرم انگاری آنها نمایند، و می توانند به استناد ماهیت فوق العاده خطرناک ذاتی انرژی هسته‌ای یا رادیواکتیو از سایر مقرره‌های مربوط به شیوه های مشابه متمایز شوند. سوالی که در اینجا پیش می آید این است که: آیا در نظام بین المللی کنونی حقوق کیفری هسته ای توسط کشور جرم انگاری شده اند و تا چه میزان موازین کیفری حقوق هسته ای در اسناد بین المللی بازتاب یافته است؟ این مقاله سعی بر آن دارد تا موازین کیفری حقوق هسته‌ای در سطوح بین‌المللی شامل کنوانسیون حفاظت فیزیکی از ماده هسته‌ای، کنوانسیون بین‌المللی سرکوب تروریسم هسته‌ای و قطعنامه‌های شورای امنیت ملل متحد را تحت سنجش و ارزیابی قرار دهد.

Abstract
|
Measuring Criminal Rules of Nuclear Law in International DocumentsPenal Code Penalties within the framework of criminal law as a group of rules applied at national, regional or international level to counteract nuclearrelated or radioactive energyrelated practices or governments requiring them to be criminally liable. Can be distinguished from other rules of the same manner based on the extremely dangerous nature inherent in nuclear or radioactive energy.
