مبانی حاکم بر شفافیت قانون‌گذاری از دیدگاه قرآن، روایات و حکمرانی خوب

شفافیت، به‌معنی آشکار بودن و در دسترس بودن اطلاعات جهت بررسی و نظارت، از موضوعات محوری در حکومت‌داری، تصمیم‌گیری و وضع قوانین است. در اندیشه‌ی سیاسی اسلام، مردم‌سالاری دینی بر آرای خام و ناآگاهانه‌ی مردم استوار نیست، بلکه جوهر آنرا آگاهی مردم شکل می‌دهد و وظیفه‌ی حاکم اسلامی به‌عنوان امانتدار مردم این است که مسائل جامعه را به‌گونه‌ای شفاف و صادقانه با مردم درمیان گذارد. شفافیت در حکومت‌های مردم‌سالار به‌‎قدری اهمیت دارد که دسترسی آزادانه به اطلاعات و علنی بودن آن شرط اول مقابله با فساد و پاسخگویی مقامات به‌حساب می‌آید. در این تحقیق به‌دنبال شناخت رویکرد اسلام به مقوله‌ی شفافیت هستیم؛ و بدین نتیجه رسیدیم که شفافیت حکومت اسلامی جزو مقوله‌‌های مورد توجه در آموزه‌‌های دینی است؛ به‌نحوی که سنت و سیره‌ی معصومین نیز بر آن صحه گذاشته و آثار متعدد آن در جای‌جای دین مورد تاکید قرار گرفته است. همچنین هم در مولفه‌های حاکم بر نظریه حکمرانی خوب و هم در تاکیدات قرآن و روایات، شاخص شفافیت از ملزومات حکومت‌داری و تشریع قوانین لازم برای اداره جامعه به شمار می‌آید.

fundamentals of legislative transparency from the qur’an, narrations and good governance perspective

transparency, which means the openness and availability of information for survey and monitoring, is a central issue in governance, decision making and rule making. from the point of view of islamic political thought, religious democracy is not based on the raw and unconscious opinions of the people, but its essence is formed by the awareness of the people; and the duty of the islamic ruler as the trustee of the people is to discuss the issues of the society in a transparent and honest way with the people. transparency is a very important issue in democracies, to the extent that free access to information and its publicity is the first condition for combating corruption and holding officials accountable. in this study, we seek to understand the approach of islam to the category of transparency; and we came to the conclusion that the transparency of the islamic government is one of the categories considered in religious doctrines; in a way that the tradition and manners of the infallibles have been confirmed and its multiple bases and function has been emphasized everywhere in islam. also, the transparency index is a requirement of governance and legislation for society management in both views of good governance theory components and qur’an and hadiths emphasis.
