بررسی نقش نظارتی دیوان عدالت اداری بر رعایت حقوق ملت در پرتو آیات قرآن

در تنظیم مناسبات دولت شهروند نمی‌توان برآوردن حقوق افراد را به حسن نیت حکومت محول نمود و دسترسی به دادرسی اداری را باید همچون ابزاری برای دستیابی شهروندان به دیگر حقوق خود در نظر گرفت. در نتیجه، علاوه بر محاکم قضایی که به اختلافات بین مردم رسیدگی می‌کنند، باید محاکم اداری بی طرف و مستقلی وجود داشته باشند که افراد در صورت نقض حقوقشان از سوی ارگان‌های دولتی و مجریان قانون بتوانند به منظور احقاق حق خود به آنجا مراجعه کنند که از جمله این محاکم، دیوان عدالت اداری است و اینکه دیوان عدالت اداری چه نقشی در نظارت بر رعایت حقوق ملت دارد؟ به عنوان مساله‌ای قابل طرح است. در این پژوهش که به روش توصیفیتحلیلی صورت گرفته این نتیجه قابل بیان است که؛ دیوان عدالت در نقش حامی و مدافع حقوق ملت، اقدامات و تصمیمات مامورین و نیز مصوبات واحدهای دولتی را زیر نظر می‌گیرد، به عنوان مرجعی قضایی به صورت غیر مستقیم در تحقق حقوق ملت با نظارت بر محاکم اداری انجام وظیفه می‌نماید.

Investigating the supervisory role of the Court of Administrative Justice on considering the rights of the nation in the Quranic verses

In regulating governmentcitizen relations, the fulfillment of individual rights cannot be entrusted to the goodwill of the government, and access to administrative proceedings should be considered as a means for citizens to achieve their other rights. As a result, in addition to the courts that deal with disputes between people, there should be impartial and independent administrative courts where individuals can go to law enforcement agencies to obtain their rights if their rights are violated by government agencies and law enforcement. Among these courts is the Court of Administrative Justice and what is the role of the Court of Administrative Justice in monitoring the observance of the rights of the nation? It can be raised as an issue. In this descriptiveanalytical study, it can be stated that; The Court of Justice, in its role of advocate and defender of the rights of the nation, monitors the actions and decisions of officials as well as the approvals of government units, and acts as a judicial authority indirectly in the realization of the rights of nation under the supervision of administrative courts.
