تحلیل نقش زمان و مکان در جواز و عدم جواز تعدد زوجات از منظر آیات و روایات

پیشرفت مادی بشر و تحولات بنیادی که در نظام اجتماعی بشر روی داده، این ضرورت را ایجاب می‌کند که تحولات و توسعه به مقتضای زمان و مکان در ترازوی فرهنگ صحیح قرار گیرد. به عبارت دیگر؛ هم در روابط انسان با طبیعت و هم در مناسبات اجتماعی انسان‌ها با یکدیگر تحولاتی بنیادی ایجاد شده است. از جمله مواردی که در حیطه حقوق خانواده، توجه و عنایت ویژه‌ای به شرایط و اوضاع و احوال پیرامون آن در احکام اسلامی شده، بحث تعدد زوجات است. به موجب این تحقیق که به روش توصیفی تحلیلی و با هدف بررسی نقش زمان و مکان در جواز و عدم جواز تعدد زوجات از منظر آیات و روایات صورت گرفته، این نتیجه قابل بیان است که؛ در وضع احکام شرعی، لازم است مقتضیات زمان و مکان، مصالح، مفاسد و منافع افراد جامعه مد نظر قرار ‌گیرد. تاثیر زمان و مکان در اجتهاد در راستای تغییر موضوعات احکام‏‎ ‎‏اجتماعی اسلام است و اگر در اثر شرایط و مصلحت، تغییراتی در موضوعات احکام از جمله تعدد زوجات ‎‏ایجاد شد، احکام آن قهراً‏‎ ‎‏عوض می‏‎‎‎‏شود.

An Analysis on Time and Place Role in Permissibility and Impermissibility of Polygamy from the Verses and Hadiths’ Viewpoint

Human economic development and fundamental changes that have taken place in the human social system, necessitate the need for changes and development to be in the correct culture balance according to the time and place. in other words; fundamental changes have taken place both in human relations with nature as well as in human social relations with each other. Polygamy is the issue which special attention has been paid to based on the conditions and circumstances Islamic law amongst all cases in the field of family laws. According to the present research in which the applied method is descriptive – analytical, with the aim of investigating the role of time and place in the permissibility and impermissibility of polygamy from the Verses and hadiths perspective, this result can be stated that: in creation religious rulings, it is necessary to consider the requirements of time and place, the expediency, corruptions and interests of the people of the society. The effect of time and place in ijtihad is in the direction of changing the subjects of the social rules of Islam, and if changes are made in the subjects of the rules as a result of circumstances and expediency, including polygamy, its rules will be forcibly changed.
