مطالعه‌ قرآنی و روایی در مشروعیت حقوق انتفاعی: حق عمری، رقبی و سکنی

در امور معیشتی انسان، حق مهمی به نام حق انتفاع وجود دارد، که قانونگذار در قانون مدنی و فقها احکام و آثار آن را بیان نموده ‌است. در این پژوهش سعی شده است که ادله‌ مشروعیت حقوق انتفاعی از جمله حق عمری، رقبی و سکنی با توجه به مطالعات قرآنی و روایی بیان شود. لیکن آنچه عموماً بر فعل خیرات و انفاق درراه خداست، می‌تواند از ادله‌ی مشروعیت این حقوق انتفاعی باشد، که به آیاتی از آن اشاره گردید. همچنین در این پژوهش به سایر ادله از جمله ادله روایی، عمل صحابه پیامبر(ص) و بناء عقلا به ‌عنوان منبع مشروعیت حقوق انتفاعی پرداخته شده‌ است. هدف از این پژوهش واکاوی مشروعیت حق انتفاع با توجه به منابع فقهی اسلامی است. بنابراین با توجه به پیدایش مصادیقی نو و مستحدثه در این موضوع فقهای بزرگ اسلامی و حقوقدانان اسلامی ملاک معینی برای مشخص شدن انواع و احکام حق انتفاع دارند.

Quranic study and narration on the legitimacy of for-profit rights: life, competitive and residential right

In human livelihood, there is an important right called forprofit right, which the legislator has stated in the civil law and jurists of its rules and effects. In this research, it has been tried to express the reasons for the legitimacy of forprofit rights, including the life, competitive and residential right, according to Quranic and narration studies. But what is generally about the act of charities in the way of God can be one of the proofs of the legitimacy of these forprofit rights, of which verses have been mentioned. Also, in this research, other reasons such as narrative reasons, the actions of the companions of the Prophet (PBUH) and the basis of reason have been discussed as as a source of legitimacy of forprofit rights. The purpose of this study is to investigate the legitimacy of forprofit right according to Islamic jurisprudential sources. Therefore, according to the emergence of new and emerging examples in this matter, the great Islamic jurists and Islamic jurists have a certain criterion for determining the types and rules of forprofit right.
