نقش دولت با محوریت اخلاق دینی در پیشگیری از نقض محرمانگی داده‌ها در فضای مجازی

حریم خصوصی یکی از بسترهای جرم‌خیز در فضای مجازی است. این حریم، از جمله مهم‌ترین حقوق فردی است که هم از نگاه شرع مقدس اسلام و هم از دید قوانین کشورها و اسناد بین المللی، محترم و مصون از تعرض است. اما نقض حریم خصوصی و حفظ امنیت و سلامت کاربر در جامعه ما کم‌تر مورد توجه قرار گرفته است. از همین رو در این نوشتار با پرداختن به حوزه اخلاق دینی، که هم پشتوانه‌های استدلالی اخلاق کاربران را تحکیم می‌بخشد و هم ضمانت اجرای کارآمدی در اختیار قرار می‌دهد و نیز شرط مکمل راهبرد فردی اخلاقی جامعه پذیری دینی، تقویت روحیه خود دیگرپنداری، آشناسازی با پیامد منطقی رفتار کاربران و نهادینه سازی امر به معروف و نهی از منکر است سعی در آموزش و بالابردن فرهنگ اجتماعی در خصوص جرایم سایبری شده است. همچنین به لحاظ اهمیت محرمانگی داده‌ها و حفظ حریم خصوصی افراد در فضای مجازی به تعریف این عامل و نقشی که دولت در آموزش اخلاق دینی به جامعه دارد پرداخته شده تا شاید نواقضی که در این زمینه وجود دارد، برطرف گردد.

Government’s Role in Preventing Data Privacy Violation by focusing Religious Ethics

Privacy is one of the fields of crime hotspots in cyberspace. This privacy is one of the most important individual rights which is respected and protected both from the sacred law of Islam’s point of view and from the perspective of international law and international documents. But violation of privacy and keeping protection of user safety and health have received less attention in our society. Therefore, the present essay which reinforces either the rationale bullion of ethics of users or known as the guarantee for effective implementation as well as providing a complement to the individualethical strategy of religious socialization, reinforcing the spirit of selfawareness, familiarity with logical consequence of user behavior and institutionalization of popularity and the prohibition of evil is the attempt to educate and elevate social culture about cybercrime by addressing the field of religious ethics. Also because of the importance of data privacy and privacy in cyberspace, the definition of this factor and the role that the government plays in teaching religious ethics to the society have been addressed and offered.
