تحریم های یکجانبه ،جنایت علیه بشریت و صلح جهانی (مطالعه موردی تحریم آمریکا علیه ایران)

تحریم های یک جانبه ابزاری در دست دولت ها و در حال تبدیل شدن به یک رویه بین المللی است ، با استناد به فصل هفتم منشور سازمان ملل متحد ، وظیفه تشخیص تهدید علیه صلح ،نقض صلح و عمل تجاوز و همچنین اتخاذ مکانیسم اجرایی بر اساس ماده 39 و مواد 41 و 42 منشور برعهده شورای امنیت می باشد. تحریم های یک جانبه در واقع نوعی تهدید محسوب شده و کشورهای اعمال کننده با این کار خود مرتکب رفتاری مغایر با منشور سازمان ملل می شوند. پژوهش حاضر با استفاده از روش توصیفی- تحلیلی و منابع کتابخانه ای به دنبال پاسخ به این سئوال است: تحریم های یک جانبه کشورها ،ناقض حقوق بشر و تهدید کننده صلح و امنیت بین المللی هستند؟ با تامل در اظهار نظر مستقیم یا غیر مستقیم سران دولت های تحریم کننده به ویژه ایالات متحده آمریکا این طور استنباط می شود که، تحریم های یک جانبه به واقع نوعی تهدید بوده ؛ موضوعی که با بند ب ماده 16 اساسنامه نورنبرگ ارتباط داشته و رابطه بین حقوق بشر و صلح و امنیت بین المللی بسیار نزدیک بوده ، صلحی را که با قربانی کردن حقوق بشر بدست آمده باشد نمی توان صلح نامید، بلکه بیشتر شبیه به آرامشی است که به زور سرنیزه و حکومت نظامی بدست آمده باشد و با نقض قواعد آمره حقوق بشر و بشردوستانه برقرار شود. تحریم ها ی اقتصادی جامع با نفی تجارت آزاد ، تهدیدی بر صلح هستند و ناقض اصول کلی و معاهدات بین المللی می باشند.

u.s. unilateral sanctions against iran conflict with the fundamental principles of international law and the provisions of the un charter, lacking legal legitimacy. under the collective security system, the determination of threats to peace and the imposition of coercive measures fall within the exclusive authority of the security council, and any unilateral action outside this framework violates state sovereignty and equality. sanctions, particularly when extraterritorial, infringe upon fundamental human rights, including the rights to life, health, and an adequate standard of living, while also limiting the right to development. by weakening domestic stability, exacerbating humanitarian crises, and destabilizing the region, such measures constitute a threat to international peace and security. peace achieved through human rights violations is fragile and unsustainable. in sum, u.s. unilateral sanctions against iran violate human rights and undermine the collective security system of the un, posing a serious threat to the rule of law and lasting peace.
