بررسی چارچوب قانونی برای حفاظت از محیط‌زیست در فضای جو، ارائه راه کارهای مناسب برای پر کردن شکاف‌های قانونی

بیش از پنجاه سال است که انسان به کاوش و اکتشاف در فضا پرداخته است و در این مدت، دستاوردهای چشمگیری در زمینه فضا و فضانوردی به دست آمده است. اما علی‌رغم پیشرفت‌های زیاد، چالش‌هایی نیز برای طبیعت و نیز انسان رخ داده است. یکی از این چالش‌ها زباله‌های تولید شده و یا انتقال داده شده به فضا هستند. این زباله‌ها آسیب‌های زیادی را برای محیط‌زیست فضا، کره زمین و انسان‌ها ایجاد کرده است. نبود قانون‌های مناسب و یا عدم کارایی این قانون‌ها مخصوصا پیرامون چارچوب قوانین بین‌الملل، مسئولیت پذیرش و مسئولیت ایجاد زباله، مخصوصا زباله‌‌های هسته‌ای سبب شده است که تهدیدهای موجود در سال‌های اخیر جدی‌‌تر شوند. هدف اصلی این مقاله بررسی شکاف‌های سیاستی و نیز قوانی موجود پیرامون زباله‌های فضایی با استفاده از روش توصیفی- تحلیلی است. همچنین این مقاله سعی دارد راه‌حل‌هایی شامل انطباق با اصول حقوق محیط‌زیست، تعریف زباله‌های فضایی تحت قوانین بین‌المللی و یک روند اصلاحی برای پر کردن شکاف‌های قانونی موجود ارائه ‌کند. بررسی شکاف‌های موجود نشان از نیاز به افزایش تلاش‌های موجود برای کاهش زباله‌های فضایی است. در انتها اتخاذ یک سیاست مشترک توسط دولت‌ها برای قبول زباله‌‌های فضایی و همچنین مسئولیت‌پذیری در قبال آن، امری ضروری به نظر می‌رسد.

for over half a century, humanity has ventured into space, leading to significant advancements in space exploration and astronautics. however, alongside these achievements have come challenges for both the environment and human life. one of the pressing issues is space debris—waste produced or transferred into space—which has caused significant harm to both the space environment and humans. the absence of effective laws, particularly regarding the international legal framework for responsibility in generating and managing waste, including nuclear waste, has exacerbated these threats in recent years. the primary aim of this article is to examine the policy gaps and existing laws surrounding space debris using a descriptive-analytical approach. additionally, the article proposes solutions, such as adherence to environmental law principles, defining space debris within international law, and implementing a corrective process to address current legal gaps. the analysis of these gaps underscores the urgent need to intensify efforts to reduce space debris, along with the necessity for a unified policy that acknowledges responsibility for the creation and management of space debris.
