شناسایی و اولویت‌بندی خسارات وارده به محیط زیست در نظام حقوقی ایران با رویکرد مدل‌سازی ساختاری تفسیری

تخریب محیط‌زیست یکی از معضلات اجتماعی اساسی عصر حاضر و از اساسی‌ترین موضوعاتی است که در حقوق محیط‌زیست به آن پرداخته می‌شود. گسترش آلودگی‌های مختلف، تغییر آب‌وهوا، تحلیل لایه ازن، کاهش تنوع زیستی و تعداد بی‌شمار معضلات محیط‌زیستی که حیات انسان‌ها را در کره خاکی تهدید می‌کنند و کیفیت حیات را به‌شدت تقلیل داده‌اند، واقعیتی انکارناپذیر است که بشر امروزی سخت با آن دست به گریبان است. هدف از پژوهش، ارایه مدلی برای خسارات وارده به محیط‌زیست در حقوق ایران است. با مرور مبانی نظری و اخذ نظر از خبرگان، موضوع در قالب شش شاخص (آلودگی هوا، آلودگی آب، آلودگی خاک، آلودگی صوتی، آلودگی نفتی، آلودگی رادیو اکتیو) دسته‌بندی شد؛ سپس پرسشنامه ماتریسی ساخت‌یافته برای تعیین ارتباطات بینابینی این شاخص‌ها تدوین گردید. داده‌های حاصل از پرسشنامه با استفاده از مدل‌سازی ساختاری تفسیری، تحلیل و در پنج سطح در یک شبکه تعاملی ترسیم شد که درنتیجه شاخص «آلودگی هوا» در بالاترین سطح قرار گرفت. لذا با توجه به تاریخچۀ نسبتاً طولانی وضع قوانین و مقررات مرتبط با آلودگی هوا در ایران، بقای این معضل می‌تواند شاهدی بر عدم توفیق مراجع قضایی ایران در این زمینه باشد. این در حالی است که با ابزارهای قضایی موجود می‌توان مانع تخلف از قوانین و مقررات مرتبط با آلودگی هوا شد یا عاملان تخلف از این قوانین و مقررات را مجازات و آنها را ملزم به جبران خسارت‌های وارده نمود.

identification and prioritization of environmental damage in legal system of iran with interpretive structural modeling approach

destruction of environmention is one of the fundamental social problems of the current era and one of the most fundamental issues addressed in environmental law. the spread of pollution, climate change, ozone depletion, biodiversity loss and the myriad of environmental problems that threaten human life on earth and severely reduce the quality of life is an undeniable fact that today’s human beings are struggling with that. the purpose of this study is to provide a model for environmental damage in iranian law. by reviewing the theoretical foundations and obtaining opinions from experts, the issue was categorized into six indicators (air pollution, water pollution, soil pollution, noise pollution, oil pollution, radioactive pollution); then, a structured matrix questionnaire was developed to determine the interrelationships of these indicators. the data obtained from the questionnaire were analyzed using interpretive structural modeling and plotted on five levels in an interactive network, as a result of which the &air pollution& index was at the highest level. therefore, given the relatively long history of legislation and regulations related to air pollution in iran, the survival of this problem can be evidence of the failure of iranian judicial authorities in this area. however, with the available legal tools, it is possible to prevent violations of laws and regulations related to air pollution, or to punish the perpetrators of violating these laws and regulations and to oblige them to compensate the damages.
