عملکرد فوری ضابطان دادگستری در رسیدگی امور کیفری و مدیریت انتظامی جرم- موردمطالعه اسناد قانونی ملی و بین‌المللی

زمینه و هدف: عملکرد ضابطان دادگستری در حساس‌ترین زمان پس از وقوع جرم که با هدف جلوگیری از امحاء ادلّۀ جرم و سعی در کشف جرم و شناسایی متهم انجام می شود، اهمیت قابل‌توجهی دارد و از این منظر، اندک تعلل می‌تواند مسیر پرونده‌های قضایی را با معضلاتی روبه‌رو سازد؛ لذا این پژوهش با هدف بررسی نقش عملکرد فوری ضابطان دادگستری در رسیدگی امور کیفری و مدیریت انتظامی انجام شده است.روش: پژوهش پیش‌رو از نظر هدف، کاربردی با رویکرد کیفی و از نوع اکتشافی است. جمع‌آوری داده‌ها از طریق فیش‌برداری انجام شد. موضوع و جامعۀ موردپژوهش، اسناد قانونی ملی و بین‌المللی است که به‌صورت تمام‌شمار انتخاب و به شیوۀ تحلیل محتوا مورد تحلیل قرار گرفته است. برای اعتبارسنجی داده‌ها از راهبرد کنترل و بازبینی بیرونی استفاده شد.یافته‌ها: طبق یافته‌های حاصل از اسناد ملی و بین‌المللی مشخص گردید که مواردی همچون: سرعت در تکمیل دستورات مرجع قضایی، ارسال سریع متهم و پرونده به مرجع قضایی، اعلام سریع جرم و کسب تکلیف از مقام قضایی و همچنین رعایت مدت تحت نظر، همگی مولفه‌هایی هستند که کلیدی‌ترین رویکرد آن‌ها بحث زمان است.نتیجه‌گیری: برابر نتایج این پژوهش، کاهش پرونده‌های تحت رسیدگی در دادسرا، تقویت زیرساخت‌های پلیسی ازجمله گشت‌های پلیسی، نیروی انسانی، تجهیزات کشف جرم در کلانتری‌ها و پلیس‌های تخصصی، موجب رعایت اصل سرعت و زمان‌های پیش‌بینی‌شده در مقررات قانونی خواهد شد. این امر مبین آن است که در حقوق کیفری ایران و رویۀ قضایی، اصل عملکرد فوری، سریع و بهنگام در امور پلیسی و قضایی نیازمند توجه جدی است.

immediate performance of judicial officers in criminal proceedings and crime management: a study of national and international legal documents

background and aim: the performance of judicial officers in the critical period following the commission of a crime, with the goal of preventing the destruction of evidence, attempting to uncover the crime, and identifying the suspect, is of significant importance. even a slight delay can cause significant issues in the judicial process. therefore, this study aims to examine the role of judicial officers’ immediate actions in handling criminal cases and crime management.method: this applied research uses a qualitative, exploratory approach. data were collected through note-taking. the subject and population of the study included national and international legal documents, which were selected through a comprehensive sampling method and analyzed using content analysis. for data validation, external review and control strategies were applied.results: according to the findings from the national and international legal documents, key factors such as the speed of completing judicial orders, the swift transfer of the suspect and case file to the court, prompt crime reporting, obtaining judicial instructions, and observing detention periods were identified. all these factors have the common theme of time management.conclusion: the results of this study suggest that reducing pending cases in the prosecution office, enhancing police infrastructure, such as patrols, human resources, and crime detection equipment in police stations and specialized police units, will ensure the adherence to legal timeframes and the principle of speed. this indicates that in iranian criminal law and judicial practice, the principle of immediate, rapid, and timely performance in police and judicial matters requires serious attention.
