تحلیل جرم‌شناختی علل وقوع ضرب‌وجرح در انجام وظایف قانونی ضابطین عام دادگستری و راهکارهای پیشگیری از آن در شهر اهواز

زمینه و هدف: ازآنجا‌که ضابطین عام قضایی نمادی از حاکمیت محسوب می‌شوند، رفتار مجرمانه آن‌ها در راستای انجام وظایف ضابطیت به نحوی اثربخش و فراگیر است که می‌تواند حقوق طرفین پرونده و حقوق جامعه را تضییع کند و موجب سلب اعتماد شهروندان و جامعه به نظام قضایی حاکم گردد. هدف از انجام این پژوهش، شناخت علل وقوع ضرب‌وجرح در انجام وظایف قانونی پلیس و ارائه راهکارهای پیشگیرانه است.روش: این تحقیق از نظر هدف کاربردی از نوع پیمایشی است. جامعۀ آماری آن شامل ضابطین عام دادگستری اهواز بود که تعداد 360 نفر از ضابطینی که در ادوار گذشته مرتکب جرم در راستای وظایف ضابطیت شده‌اند، به‌صورت تصادفی به‌عنوان حجم نمونه گزینش شد و از طریق پرسش‌نامۀ محقق ساخته در بحث علت‌شناختی جرائم و راهکارهای پیشگیرانه مورد تحقیق قرار گرفتند. برای تجزیه‌وتحلیل داده‌ها از نرم‌افزار spss26 و آزمون‌های آنالیز واریانس استفاده شد.یافته‌ها: نتایج نشان می‌دهد، در بحث وقوع جرم ضرب‌وجرح ماموران، عواملی از قبیل برخورد ناشایست برخی از شهروندان یا متهمین با مامورین و تحریک آن‌ها، کمبود امکانات و تجهیزات پیشرفته در راستای کشف جرائم، نوع ماموریت‌های محوله، لزوم توجه بیشتر به شان و منزلت پلیس؛ همچنین در زمینۀ پیشگیری از این جرم، عواملی مانند استفاده از روان شناس در کنار کارکنان، استفاده از کارکنان باتجربه در مناطقی که دارای فقر فرهنگی هستند و بهبود روش‌ها در جهت کاهش تماس و ارتباط مردم با یگان‌های انتظامی بیشترین تاثیرگذاری را دارند.نتیجه‌گیری: با عنایت به نتایج تحقیق، راهکارهایی ازجمله شناسایی کارکنان صحیح العمل و به‌کار گرفتن آن‌ها در مشاغل ارتباطی با مردم، رسیدگی سریع و قاطع قضایی و انضباطی به پرونده‌های کارکنان و حضور مبادی نظارتی در کنار کارکنان در ماموریت‌ها ارائه شد.

causal analysis of assaults in the performance of legal duties by law enforcement officers and preventive measures in ahvaz city

background and aim: as public prosecution officers are considered symbols of authority, their criminal behavior in carrying out their duties can have significant and widespread negative consequences, leading to the violation of the rights of parties involved in cases and societal rights. this behavior can also undermine public trust in the judicial system. the aim of this research is to identify the causes of assaults during the performance of legal duties by police officers and provide preventive measures.method: this research is an applied survey study. the study population consisted of public prosecution officers in ahvaz. a random sample of 360 officers who had committed crimes related to their duties in previous years was selected, and they were surveyed using a researcher-developed questionnaire on the causal factors of crimes and preventive measures. data analysis was performed using spss26 software and analysis of variance tests.results: the results indicate that factors such as inappropriate behavior of some citizens or suspects towards officers and provocation, lack of advanced facilities and equipment for crime detection, types of assigned missions, and the need for greater attention to the dignity and status of the police play a role in the occurrence of assault crimes against officers. in terms of prevention, factors such as the use of psychologists alongside staff, employing experienced personnel in culturally deprived areas, and improving methods to reduce contact and communication between the public and law enforcement agencies have the greatest impact.conclusion: based on the research findings, suggested preventive measures include identifying competent employees and utilizing them in communication-related professions with the public, prompt and decisive judicial and disciplinary proceedings regarding employee cases, and the presence of supervisory checkpoints along with employees during their missions.
