آسیب شناسی تعامل پلیس و قوه قضائیه در پیشگیری از جرم

زمینه وهدف‌: قانون اساسی و قانون تشکیل نیروی انتظامی،پلیس را به عنوان ضابط مسئول اجرا بخشی از وظایف قوه قضائیه در قبال جرم و پیشگیری از آن معرفی کرده است. ازآنجایی که کیفیت تعامل و همکاری بین دو سازمان از شروط و ضرورت های اولیه پیشگیری از جرم است، این تحقیق با هدف آسیب شناسی تعامل دستگاه قضایی با نیروی انتظامی در پیشگیری از جرم انجام شده است.روش: این تحقیق توصیفی از نوع پیمایشی بوده و جامعه آماری آن320 نفر، شامل کلیه مسئولان و کارشناسان خبره و مطلع پلیس پیشگیری و معاونت پیشگیری از جرم قوه قضائیه می باشند که از بین آنها با استفاده از جدول مورگان 175 نفربه عنوان حجم نمونه به روش تصادفی طبقه‎ای متناسب با حجم انتخاب شدند. برای حصول روایی صوری و محتوایی سوال ها از نظر 15 نفر از خبرگان بهره گرفته و برای سنجش پایایی پرسشنامه از روش باز آزمایی استفاده شد و همبستگی بین نمرات حاصل از دوبار اجرای آزمون 0/86 به دست آمد.یافته ها: اجرای ماموریت مشترک پیشگیری از جرم توسط نیروی انتظامی و دستگاه قضایی با سطح همبستگی بالا و معناداری تابعی از استنباط‌ هر دو نهاد از مفهوم پیشگیری است. همچنین نتایج آزمون‌های آماری نشان داد کارکنان دو دستگاه نگرش واحدی از مفهوم پیشگیری از جرم ندارند و دانش و نگرش پیشگیری از جرم در دو سازمان یکسان نیست.نتیجه گیری: در سطح شناختی و فرهنگ سازمانی موانع جدی برای تحقق ماموریت پیشگیری از جرم وجود دارد که از مصادیق آن می توان به نداشتن سند همکاری و  برنامه مشترک بین دو سازمان اشاره کرد.

background and aim: the constitution and the law on the formation of the police force have introduced the police as officers responsible for the implementation of part of the duties of the judiciary in relation to crime and its prevention. since the quality of interaction and cooperation between two organizations is one of the first conditions and necessities of crime prevention, this research was conducted with the aim of analyzing the interaction between the police and the judiciary in crime prevention.method: this descriptive research is a survey type and its statistical population was 320 people, including all officials and expert experts and informants of the prevention police and the deputy of crime prevention of the judiciary, of which 175 people were selected using morgan’s table as the sample size. they were randomly selected according to the volume according to the method. in order to obtain formal and content validity of the questionnaire questions, the opinion of 15 experts related to the subject was used. also, to measure the reliability of the questionnaire, the retest method was used and the correlation between the scores obtained from the test twice was calculated as 0.86.results: the implementation of the joint mission of crime prevention by the police force and the judicial system with a high level of correlation and significance is a function of the inference of both institutions from the concept of prevention. also, the results of the statistical tests showed that the employees of the two organizations do not have a single attitude towards the concept of crime prevention, and the knowledge and attitude of crime prevention are not the same in the two organizations.conclusion: at the cognitive level and organizational culture, there are serious obstacles to the realization of the crime prevention mission, examples of which are the lack of a cooperation document and joint program between the two organizations.
