مسئولیت حمایت و‌ استیلای طالبان بر افغانستان درپرتو دیالکتیک هنجارهای بشری

وضعیت افغانستان دارای جایگاه ژئو سیاسی است و وقایع آن توجه قدرت‌های بزرگ دنیا را جلب می‌کند. یورشهای نظامی، بازداشت‌های خودسرانه، کوچ اجباری، رعب و وحشت، ناامنی، عملیات تروریستی مکرر و سلب حقوق زنان و کودکان و مردان افغانی از جمله اقداماتی بوده که با تسلط افغانستان توسط طالبان در اوت 2021 رخ داد. این درحالی است که حاکمیت یک دولت باید در بردارنده تعهد حمایت از افراد تحت صلاحیتی آن باشد زمانی که دولتی به این تعهد عمل نمی‌کند باید انتظار واکنش جامعه بین‌المللی را داشت. این مقاله با روش توصیفی و تحلیلی در صدد است با در نظر داشتن وضعیت اخیر افغانستان و تسلط طالبان ، با تاکید بر لزوم رعایت تعهدات حقوق بشری نسبت به ملت افغانستان از طرف طالبان، امکان اعمال دکترین مسئولیت حمایت را به عنوان راه‌کاری برای خاتمه به وضعیت نابسمان افغان‌ها مطرح نماید تا در نهایت مشخص شود که مسئولیت حمایت مستلزم تعهد ایجابی در ذات مفهوم سنتی حاکمیت دولت‌ها است. حاکمیت نه تنها حق بلکه مسئولیتی است که به موجب آن یک دولت به مراقبت و رعایت حقوق افراد تحت صلاحیت خود متعهد می‌باشد به این ترتیب در رابطه دیالکتیکی میان حاکمیت از یک طرف و ارزش‌های بشری از طرف دیگر آنتی تز مسئولیت حمایت قابل ارائه است

responsibility to protect and taliban domination of afghanistan in the light of the dialectic of human values

the situation in afghanistan has a geopolitical status and its events attract the attention of the world’s great powers. military offensives, arbitrary detentions, forced relocations, intimidation, insecurity, and the disenfranchisement of afghan women, children, and men were some of the actions that took place in august 2021 when the taliban took control of afghanistan.however, the sovereignty of a state must include a commitment to protect those under its authority. when a government does not fulfill this commitment, it must expect the reaction of the international community. this article seeks to describe the recent situation in afghanistan in a descriptive and analytical manner, emphasizing the need for the taliban to fulfill their human rights obligations to the afghan people, introduce the possibility of applying the doctrine of protection responsibility as a way to end the plight of afghans, finally, it becomes clear that the responsibility to protect requires a positive commitment inherent in the traditional concept of sovereignty of states. sovereignty is not only a right but also a responsibility under which a state is committed to safeguarding and respecting the rights of those under its jurisdiction. in this way, in the dialectical relationship between sovereignty on the one hand and human values on the other, the antithesis of the responsibility of protection can be presented.
