واکاوی انتقادی نظریه های قانون طبیعی در اولین مرحله احیای آن در دوره پساتجدد

قانون طبیعی در مشهورترین تفسیر خود، فرمان‌های ثابت و دائمی عقل عملی درباره رفتارهای اختیاری بشر هستند که انسان‌ها با اطاعت از آنها در همه زمان‌ها و مکان‌ها به خوشبختی می‌رسند. به دنبال تسلط اندیشه تجربه‌گرایی (پوزیتیویسم) بر عقل‌گرایی در قرن 19 میلادی، مباحث مربوط به قانون طبیعی با پیشینه 25 قرن نیز از رونق افتاد و گفتمان قانون طبیعی به آرامی به فراموشی سپرده شد. با گذشت بیش از یک قرن، دوباره مطالعه قانون طبیعی در دوره پساتجدد قرن بیستم با جدیتی بیش از دوره-های گذشته پیگیری شد و گرایش به رویکردهای نو درباره این آموزه در سه مرحله احیا گردید. پرسش اصلی این مقاله عبارت است از اینکه: نظریه‌های غربی قانون طبیعی در اولین مرحله احیای آن (1890 - 1940) در دوره پساتجدد کدامند و چه کاستی‌هایی دارند؟ برای پاسخ دادن به این پرسش، این مقاله نظریه‌های متنوع قانون طبیعی را در اولین مرحله احیای آن در قرن بیستم در ضمن سه گفتار نقد و بررسی می‌کند. در گفتار اول پس از شرح نظریه‌های پساتجدد غیرکاتولیک، کاستی‌های آنها بیان می‌شوند. گفتار دوم به مطالعه نظریه‌های کاتولیک در آن دوره پرداخته و اشکال‌های آنها را توضیح می‌دهد. آخرین گفتار نیز کاستی‌های مشترک همه نظریه‌های پساتجدد قانون طبیعی را در اولین دوره احیای آن بیان می‌کند.روش پژوهش در این مقاله، ترکیبی از روش‌های نقلی، عقلی و انتقادی است.

critical review of natural law theories in its first revival stage in postmodern period

according to the most popular interpretation of natural law، it is constant and enduring commands of practical reason regarding free human behaviours by which humans arrive at happiness in all times and places.following the domination of empiricism thinking (positivism) on rationalism in the 19th century، natural law discussions were slackened and natural law was forgotten gradually. after more than a century، the study of natural law was again pursued with more endeavor in postmodern period in the 20th century and the inclination to new attitudes about this teaching was revived in three stages. the main question of this article is: what are western natural law theories in its first revival sage in postmodern period and what are their deficiencies? to answer to the question in three chapters، this paper criticizes various theories of natural law in its first stage of revival in the 20th century. after explicating postmodern non-catholic theories in the first chapter، their deficiencies will be mentioned. the second chapter will analyze catholic theories in the period and will explain their defects. the last chapter also indicates common deficiencies of all postmodern natural law theories in the first period of its revival. research method in this paper is a component of traditional، rational and critical methods.
