کاربرد وکالت عرفانی در ماهیت وکالت دادگستری

تعریف و مبنای وکالت در دادگستری را بایستی در علوم پیشینی آن و در مباحث «فلسفۀ حقوق هنجاری»، جستجو نمود. در وکالت، نیابت و اجازه از دیگری اهمیت دارد که در تاریخ تمدن ملت‌ها بر اساس مبانی فکری و اخلاقی و اجتماعی آنها استوار است. در این مقاله تلاش می‌گردد تا یکی از این مبانی فلسفۀ حقوق هنجاری که به حوزۀ عرفان ارتباط می‌یابد و آن توکل و وکالت عرفانی است، ریشه یابی شود و جایگاه وکالت در مبانی فکری عرفانی و حقوقی مورد توجه قرار گیرد و در مقایسه با وکالت دادگستری، نقش زمینه‌‌های فکری و معنوی و اخلاقی در علوم قضایی کاوش گردد و با روش کتابخانه‌ای و با ارجاع به منابع اولیۀ این دو رشته، این نتیجه را روشن نماید که وکالت معنایی گسترده دارد که شاخه‌ای از آن در عرفان ریشه دارد و از توکل نیز مایه می‌گیرد. از نظر حقوقی نیز شرط اخلاقی، رعایت مصلحت موکل، امانتداری و حفظ اسرار در آن رعایت می‌شود.
