تحریم های اقتصادی و تعهدات کشورها در سازمان جهانی تجارت و ارائه راهکارهای بین المللی

سازمان ملل صلاحیت اعمال تحریم های اقتصادی را به منظور حفظ صلح و امنیت بین المللی دارد که در چارچوب فصل هفتم منشور ملل متحد به شورای امنیت سپرده شده است. تحریم های بین المللی هم توسط سازمان های بین المللی و هم از سوی دولت ها به دلیل نقض قوانین بین المللی اعمال می شود. قوانین و مقررات سازمان تجارت جهانی به جامع ترین هنجارهای بین المللی در زمینه تجارت و به عبارتی قانون اساسی تجارت جهانی تبدیل شده است و کشورها خواه عضو این سازمان باشند یا نباشند چاره ای جز این ندارند که مطابق با قوانین و مقررات این سازمان باشند. این پژوهش با طرح این سوال که تحریم های اقتصادی بر تعهدات کشورها در سازمان تجارت جهانی چه تاثیری دارد و چه راهکارهای بین المللی در مرتفع نمودن ناشی از آن می توان مطرح نمود این فرضیه را بیان کرده است که تحریم های اقتصادی در پیوستن (الحاق) کشورها به سازمان تجارت جهانی تاثیر مستقیم دارد و مانعی در برابر اجرای تعهدات ناشی از سازمان جهانی تجارت می باشد.

economic sanctions and obligations of countries in the world trade organization and providing international solutions

the united nations possesses the authority to impose economic sanctions to uphold international peace and security, which is entrusted to the security council under the framework of the seventh chapter of the united nations charter. international sanctions are enforced by both international organizations and governments in response to violations of international laws. the rules and regulations of the world trade organization (wto) have evolved into the most comprehensive international norms in the field of trade, often referred to as the world trade constitution. regardless of their membership status, countries are obligated to comply with the rules and regulations of the wto. this research aims to explore the impact of economic sanctions on the obligations of countries within the wto and propose international solutions to address the resulting consequences. the hypothesis put forth is that economic sanctions imposed on countries during their accession process directly affect the functioning of the wto and impede the fulfillment of obligations stemming from membership in the organization.
