صورت‌بندی روابط حقوق و اخلاق در آرای علامه طباطبایی

پژوهش حاضر با روش توصیفی‌تحلیلی، صور ارتباطی حقوق و اخلاق را ازمنظر علامه طباطبایی ترسیم می‌کند. این رابطه در سه صورت طرح می‌شود که این صورت‌ها با سه مسلک اخلاق در نگرش علامه طباطبایی تناظر می‌یابند. مطابق صورت نخست و در تناظر با اخلاق دنیویْ حقوق و اخلاق در ملازمت با یکدیگر به‌عنوان اعتبارات بعد از اجتماع شناخته می‌شوند و به‌طور مشترک، وظیفۀ تامین سعادت دنیوی را بر عهده دارند. مطابق صورت دوم و در تناظر با اخلاق دینیْ حقوق و اخلاق معادل با رعایت واجبات احکام هستند؛ اما حوزۀ خاص اخلاق تقید بر مستحبات، همراه با تصفیۀ باطن از غبار سوء‌نیت‌هاست که درنتیجه اخلاق با وصف تمایل به استقلال تدریجی از حقوق شناخته می‌شود. مطابق صورت سوم و در تناظر با اخلاق الهی، حقوق محدود به قواعد زندگی این‌جهانی است که پس از عزیمت انسان به ساحت مجردات، بقا، استقلال و تفوق اخلاق نمایان می‌شود.

The Relationship of Law and Ethics According to Tabatabaei

This article, by descriptive analytic method, aims Tabatabaei’s interpretation of law and ethics relationship and formulates this topic according to his words. corresponding to Tabatabaei’s formulation of three ways of ethical life which is called as public ethics, religious ethics and divine ethics in this article We can say: there are three kinds and stages of relationship between law and ethics. At first, it seems that law and ethics play a common role and make human social individual life secure by employing Constructional Perceptions. At second level, we receipt that law and ethics are almost separate each other; in this form, law is overlapped with religious jurisprudence, and ethics will be attached to extra task behaviors. Finally, in the third kind of relationship, law is considered as common and popular rule of human secular nature and life. So, this rule is finished and ended by human transformation to spiritual word.
