بررسی تحلیلی میراث زوجه از اموال شوهر در فقه امامیه و حقوق ایران

مسئله سهم‌الارث زوجه از اموال شوهر یکی از مباحثی که به طور ویژه‌ای به آن پرداخته‌شده است. در مورد محرومیت زوجه از ارث‌بردن بعض از ترکه شوهر که از منفردات امامیه است و بر آن ادعای اجماع شده است، اتفاق نظر کامل وجود ندارد و آرا و عقاید مخالف نیز وجود دارد. در مورد انواع اموالی که زوجه از آن‌ها ارث نمی‌برد و همچنین در مورد اینکه این حرمان اختصاص به زوجه غیر ذات ولد دارد یا مطلق زوجه، به سبب اختلاف روایات، اقوال و آرا متفاوتی از جانب فقها ابراز گردیده است. حقوقدانان نیز به پیروی از فقها نظرات مختلفی در این خصوص ارائه  نموده‌اند. اخیراً مجلس شورای اسلامی نیز در جهت حمایت از حقوق زنان و اجرای عدالت از نظر فقها و حقوقدانانی پیروی کرده است که زوجه را به طور مطلق، چه ذات ولد و چه غیر ذات ولد، مستحق ارث‌بری از تمام اموال زوج از عین اموال منقول و از قیمت اموال غیر منقول اعم از عرصه و اعیان می‌داند.

Analytical study of the wife inheritance from the husband's property in Imami jurisprudence and Iranian law

Abstract One of the issues addressed specifically is the issue of wife’s share of inheritance from the property of the husband.  It isn’t fully agreed and there are opposing views and ideas about the wife deprivation from inheriting some part of husband’s bequest which is one of solitary  cases of Imami and there is a claimed consensus about it. Different opinions and views expressed by the jurists about the types of property that the wife does not inherit from it as well as the fact that this deprivation appertains to the childless wife or any kind of wife due to difference between traditions (Hadiths). Also lawyers following the jurists have presented different views in this regard. Recently the Islamic Consultative Assembly in order to protect the rights of women and for administration of justice has followed the view of jurists and lawyers who believe that the wife utterly, whether childless or with child, deserves inheritance from all property of husband from the corpus of movable property or from price of  real property including arena or corpus.
