معیار عمل حاکمیت در حقوق اداری ایران

اعمال دولت در حقوق اداری، با معیار شیوه ی عمل، به دو نوع عمل تصدی و عمل حاکمیت تقسیم شده است. تقسیم بندی مذکور درحوزه های مختلف حقوق اداری از جمله تعیین قاضی صالح، تعیین رژیم مسئولیت مدنی و کیفری دولت، رژیم مالی و سازمانی دستگاه های دولتی و بالاخره تعیین حقوق استخدامی انواع کارکنان دولت به کار رفته است. در نظام حقوق اداری ایران، از معیار عمل حاکمیت در حوزه های مذکور بهره گیری شده است، لکن در این نوشتار نشان داده­ایم معیار عمل حاکمیت، به عنوان معیار تعیین صلاحیت قضایی و معیار مسئولیت مدنی دولت در سیر تحولات حقوقی منسوخ شده و درحوزه های مسئولیت کیفری و سازمانی و استخدامی نیز علیرغم اعتبار قانونی معیار مذکور، به علت ابهامات موجود در مفهوم و مصداق آن، در عمل فاقد کارایی حقوقی و قضایی بوده و اثر آن صرفا در حوزه ی سیاست گذاری محدود می شود.

The criterion of act of authority in administrative law in Iran

The acts of the State in administrative law, according the criterion of the method, are divided into act of authority and act of management. This division is used in the different areas of administrative law such as the determination of the competent judge, the rules of civil liability of the state, etc... In the system of administrative law of Iran, the criterion of the act of authority is used in the above fields. But we have shown in this writing, that the act of authority as the criterion of legal competence and the rules of civil liability of the State is canceled, and also in the areas of criminal liability and administrative organization and civil service, despite the legal credit, this criterion is without any efficiency because of vagueness in its concept, and its effect is limited in the scope of making politics.
