قانون اساسی به عنوان سند مهم، یک نظام حقوقی مفهومی بسیار پیچیده و دارای لایه‌های پنهان است. تجربه قانون اساسی در دو سده اخیر نشان داده است این مفهوم علاوه بر متن و اصول نوشته بر روی کاغذ، دارای لایه‌ها و اصولی نانوشته هم هست که در عمل و در اجرا توسط کنشگران عرصه سیاسی پدید می‌آیند. اگر این اصول و لایه‌ها نادیده گرفته شوند میان واقعیت موجود در یک جامعه و کلمات متن، گسلی عمیق ایجاد خواهد شد. به این ترتیب، متن قانون اساسی راکد شده و تحولات سیاسی به آن بی‌توجه خواهند ماند. در این مقاله کوشش شده است این مسئله بررسی شود که این اصول از کجا نشئت می‌گیرند و تاریخچه این بحث و مبانی آن به کجا بر می‌گردد. همچنین برخی از مهم‌ترین لایه‌های پنهان قانون اساسی که در متن نمی‌آیند مانند رویه‌های اساسی، عرف اساسی، شبه قانون اساسی، قوانین عادی برتر، اصول فراقانون اساسی، اصول خارج از قانون اساسی توضیح داده شده‌اند.
