«اقلیت‌های قومی در ایران» یا «اقوام ایرانی»؟ از نگاهی ژورنالیستی تا دیدگاهی حقوقی

واژه «اقلیت» از اصطلاحات بحث برانگیز در حقوق بین الملل است. هر گروه قومی که از ویژگی‌های یک اقلیت برخوردار باشد، شایسته اطلاق عنوان اقلیت قومی است و در نتیجه ذیل حمایت‌های نظام بین‌الملل حقوق اقلیت‌ها قرار می‌گیرد. ایران از دیرباز محل سکونت اقوام مختلف بوده است، اما قابلیت انطباق مفهوم حقوقی بین‌المللی «گروه‌های قومی اقلیت و غیرحاکم» بر اقوام ایرانی، در نظام حقوقی جمهوری اسلامی ایران، موضوعی است که نیاز به بررسی دارد؛ ازاین‌روی، نوشتار فرارو به پاسخ به این پرسش می پردازد که آیا در ایران گروه یا گروه‌هایی قومی وجود دارند که بر اساس موازین حقوق بین‌الملل بتوان آن‌ها را اقلیت قومی نامید؟ به باور نگارندگان، با توجه به رویه قضایی و دکترین حقوقی بین‌المللی و با عنایت به ترکیب جمعیتی و ساختار سیاسیاجتماعیفرهنگی و شمای قومیتی و نظام حقوقی جمهوری اسلامی ایران، هیچ‌یک از گروه‌های قومی کشور را نمی‌توان، به مفهوم خاص کلمه، مصداق اقلیت قومی دانست.

"Ethnic Minorities in Iran" or "Iranian Ethnic Groups"? From a Journalistic View to a Legal Standpoint

Minority is a controversial term in international law. Any ethnic group meeting the characteristics of a minority group is qualified to be called an Ethnic Minority and accordingly falls under the protection of IMRL. Traditionally, Iran has been the habitat of distinguished ethnic groups, but compatibility of the international legal concept of "the minority  and nondominant ethnic groups" on Iranian ethnic groups in I.R.I. legal system needs to be investigated. The question ,to answer which this article is written, is that according to international law criteria and regulations whether is there any ethnic minority group in Iran? The authors believe that, in accordance with international jurisprudence and doctrine and on the basis of population and politicalsocialcultural structure and ethnic design and legal system of I.R.I., none of the ethnic groups in Iran could be called an ethnic minority in its particular sense.
