تعاریف و مشخصه‌های کشتی جنگی (ناو) و اهمیت تفکیک آن از کشتی غیر نظامی از دیدگاه حقوق بین الملل

 امروزه بخش بسیار بزرگی از ارتباطات و تجارت جهانی از طریق دریاها انجام می گیرد و کشوری قویتر است که تسلط بیشتری بر دریا داشته باشد. تسلط بر دریا از طریق واحدهای شناور از جمله کشتی ها و زیردریایی ها به دست می آید که به دو گروه اصلی تجاری و نظامی تقسیم می شوند. تفاوت ها و شباهت های زیادی بین انواع کشتی ها وجود دارد و تعاریف و تقسیم بندیهای متعددی از انواع کشتی ارائه شده است. هر گروهی از دانشمندان، کشتی را از دید خود تعریف نموده اند. مقاله حاضر کشتی های نظامی را از نظر شکل ظاهری و نحوه نامگذاری و شناسایی بررسی نموده و تعاریف ارائه شده در خصوص کشتی های نظامی و چگونگی و میزان وابستگی این نوع کشتی ها به دول صاحب پرچم را به روش کتابخانه ای و با بررسی کنوانسیون ها و رویه های قضایی و قوانین کشورها مرور نموده و اهمیت تفکیک کشتی های نظامی از غیر نظامی و دلایل محدودیت بیشتر کشتی های نظامی نسبت به تجاری را از دیدگاه حقوق بین الملل بیان نموده است.    

Definition and Characteristics of Warship and the Importance of Separate it From Non Military Ship in International Law Viewpoint

Nowadays, the majority of Communication and world trade is carried through sea and the country which is the more dominant in the sea is more powerful. Dominance over the sea can be achieved through the vessels such as ships and submarines that are dividing in two main groups commercial and military ships. There are many similarities and differences between kinds of ships, so expressed various Definitions and divisions from kinds of ships. Till now, many definitions of a ship have been provided and many similarities and differences of various types of the ships have been mentioned as well. In this paper we considered the military and commercial applications of ships and reviewed the definitions of warships that have provided by the Conventions on the Law of the Sea and the laws of some countries .We also considered the physical appearance, how to name and identify these ships, the reasons for their dependence on governments, and the importance of separate warships from non military ships in international law viewpoint. In addition we mentioned the reasons for more restrictions of warships than merchant ships.
