ارزیابی چالش‌های ادغام اصول کلی حقوق بین الملل محیط زیست در حقوق دریاها

در شرایط حاضر هرگونه مقررات سازمان ملل در رابطه با حقوق دریاها، با حمایت و حفاظت از محیط‌زیست مرتبط است. سازمان ملل با توجه به ارزش غیرقابل انکار منابع دریایی و اقیانوسی در تجارت جهانی، وابستگی امنیت غذایی جوامع به وضعیت صید ماهی و به دنبال آن، اثرات مخرب بر اکوسیستم‌های دریایی، نظام خاصی برای حمایت و حفاظت از محیط‌زیست دریایی را دنبال و مسئولیتی مشترک، حسب توجه به اصول و ارزش‌های مشترک برای تداوم حیات انسانی مطرح نموده است. اصول حقوق بین‌الملل محیط زیست به طور مستقیم در جهت حمایت از توسعه پایدار و حفاظت از محیط زیست جهانی به کار می‌روند. این اصول شامل اصل احتیاط، اصل تعهد به همکاری، رویکرد اکوسیستمی و اصل مسئولیت‌های مشترک اما متمایز است. از اینرو، مقاله حاضر به بررسی چگونگی تعامل اصول کلی حقوق بین‌الملل محیط‌زیست و کنوانسیون سازمان ملل متحد در مورد حقوق دریا (unclos) پرداخته و موافقت‌نامه‌های مرتبط با آن را در طول زمان مورد بحث قرار می‌دهد. در ادامه به مطالعه اهمیت حفاظت از محیط‌زیست دریایی، تعامل اصول کلی حقوق بین‌الملل محیط‌زیست و حقوق دریاها و تاثیر اسناد جدید و تفسیر دادگاه‌های بین‌المللی بر توسعه و تکامل بخش دوازدهم کنوانسیون سازمان ملل متحد درباره حقوق دریاها در زمینه حقوق دریایی برای مقابله با چالش‌های زیست محیطی اخیر می‌پردازد.

assessment of challenges in integration of general principles of international environmental law into the law of the sea

in the current situation, the un regulations regarding the law of the seas are related to the protection of the environment. considering the undeniable value of marine and oceanic resources in world trade, the dependence of food security on the status of fishery and the subsequent destructive effects on marine ecosystems, the united nations follows a special system for the protection of the marine environment and has raised a common responsibility according to common principles and values for the continuation of human life. the principles of international environmental law are directly employed to support sustainable development and the protection of the global environment. these principles include the precautionary principle, the duty to cooperate, the ecosystem approach, and the principle of common but differentiated responsibilities. so, current paper studies how general principles of international environmental law and the united nations convention on the law of the sea (unclos) and its related agreements, have interacted with each other over time. in following, it study the importance of protecting the marine environment, the interaction of the general principles of international environmental law and the law of the sea, and the impact of the adoption of new instruments as well as interpretation by international courts on the development and evolution of the 12th part of the united nations convention on the law of the sea in the field of sea law to meet the contemporary environmental challenges.
