واکاوی رویکردهای فقهی به اعتبار جنسیت در شهادت

اعتبار شهادت زن در فقه اسلامی از دیرباز تاکنون همواره عرصه‌ی مباحث متعددی در این حوزه بوده است. با این‌حال قدمت موضوع، مانع از تازگی پرداختن به انتقادات مطرح در این قلمرو و واکاوی نگرش‌های مختلف پیرامون این موضوع، با هدف نزدیک‌ترشدن به نظر شارع نخواهد بود. در این زمینه دو رویکرد قابل طرح است. نخست؛ رویکرد جنسیت محور که با استناد به برخی دلایل نقلی و عقلی، معتقد به تنصیف ارزش شهادت زن می‌باشد. در مقابل، رویکرد دوم، در بستری تاریخ‌مند، از طریق بازتفسیر مواضع اتخاذ شده در رویکرد سنتی و واکاوی دلایل استنادی آن، به تعدیل نگرش‌هایی می‌پردازد که می‌تواند منشا سوءفهم‌های احتمالی شود و با توجه به اقتضائات زمانی و مکانی و نواندیشی‌های فقهی ـ حقوقی امکان گذر از رویکرد سنتی را فراهم کرده و زمینه‌ساز اتخاذ رویکردی نو در زمینه موضوع شهادت زن می‌شود. رویکرد اخیر، با اعتباربخشی به شهادت زن آن‌را به عنوان موضوعی خرد در جریان پویایی فقه اسلامی می‌داند که خاصیت همگامی با تحولات زمانی و مکانی را در خود می‌بیند.

Juridical Approaches Analysis based on Gender in Testimony

The credibility of women’s testimony in Islamic jurisprudence has been controversial. Although it is not a new subject and it has been proposed for a long time but this cannot avoid us not to address the new comments on this issue and not to consider different attitudes toward it in order to understand legislator’s opinion better. Two approaches can be proposed in this field. First, genderbased approach which treats a woman’s testimony as half of a man’s based on rational and narrative reasons. On the other hand, the second approach, in the historical context, attempts to adjust the attitudes which can be the cause of misunderstandings, through reinterpretation of situations in traditional approach and the analysis of citation reasons and provide the possibility to bypass the traditional approach based on time and space requirements and juridicallegal modernity in order to pave the way for a modern approach towards women’s testimony. The latter approach through accreditation to women’s testimony, assumes women’s testimony as a small issue in dynamism of Islamic jurisprudence, so that it can keep pace with time and space changes.
