نفی شرطیت احتمال تاثیر در امر به معروف و نهی از منکر

وجوب امر به معروف و نهی از منکر، مقیّد به شروطی است که یکی از آنها احتمال تاثیر میباشد. مشهور فقها معتقدند امر به معروف و نهی از منکر نسبت به شرط احتمال تاثیر وجوبی تعلیقی و مشروط دارد به طوری که در صورت علم به عدم تاثیر، وجوب امر به معروف و نهی از منکر ساقط میشود. نگارندگان با بازخوانی مساله قول دیگری را اختیار نموده و معتقدند که چنین شرطی صحیح نبوده و لذا در صورت عدم احتمال تاثیر یا علم به عدم تاثیر نیز، امر به معروف و نهی از منکر همچنان واجب است. مقاله حاضر با دفاع از موضع نگارندگان و در راستای تبیین مختار ایشان، به نقل و نقد آراء و مدارک مشهور، به ضمیمه ارائه ی ادلّه ی عدم شرطیت که نظر مختار است، پرداخته است.

The necessity of Calling People to the Goodness and Preventing People from Evil is subjected to some conditions which one of them is the effect possibility. The most jurists believe that Calling People to the Goodness and Preventing People from Evil shall have the suspended and conditional necessity proportionate to the effect possibility clause so that the necessity of Calling People to the Goodness and Preventing People from Evil shall become void, if we know that it is ineffective. The authors, while revising the issue, chose another word and believed that such condition was not accurate and Calling People to the Goodness and Preventing People from Evil is indispensable even if it is ineffective. The present article shall defend the opinion of authors and in line with the clarification of their option, verify and criticize the famous opinions and documents and submit an addendum based on nonstipulation.
