تحلیل محذورات خطابی تعبد به امارات ظنیه

بحث از حجیت امارات ظنیه (به معنی صحت و قابلیت استناد به آنها) بطور عام و حجیت خبر واحد بطور خاص از دیرباز در کهن ترین متون اصولی ما مورد توجه قرار گرفته و به مرور و کم کم دامنه ی آن گسترش یافته و مواردی نظیر حجیت ظواهر، شهرت فتوایی، قول لغوی، اجماع منقول و قیاس را نیز در بر گرفته است. در بررسی این قضیه لامحاله به تحلیل دیدگاه مخالفان تعبد به ظنون (ضمن بررسی دلایل آنها در منع از حجیت ظنون و عدم امکان تعبد به آنها با طرح محذورات ناشی از این تعبد) و موافقان حجیت آن بطور مطلق و یا بنا بر تفصیل (که دلایل و محذورات مطرح شده را توهمی دانسته و به رد محذورات مطرح شده یا مقدر ناشی از تعبد به ظنون پرداخته اند) توجه می شود. در این مقاله نیز ضمن پرداختن به سابقه تاریخی و تطور مباحث مربوطه که منجر به توسعه دیدگاه های علی الخصوص موافقان و در نتیجه طبقه بندی آنها گردیده و به بررسی دسته بندی های موجود از محذورات ذکر شده ناشی از تعبد به امارات ظنیه یعنی اجتماع حکمین اعم از متماثلین یا متضادین و رد آنها پرداخته شده است. بدیهی است با روشن شدن این مباحث و اختیار دیدگاه تفصیلی، نقش اساسی و مقدماتی در مباحث دیگر نظیرحجیت اماراتی مانند ظواهر و خبر واحد ثقه و همچنین رد حجیت برخی دیگر از امارات نظیر قیاس خواهد داشت.

The Analysis of Spoken Abandonment Originating from Following the Guessed Indications

The discussion regarding the requirement of guessed indications in general and the requirement of news specifically has been dealt with in our oldest principal texts, and its domain has gradually developed and incorporated issues including appearances, jurisprudence fame, lexical promises, spoken harmony, and analogy. In investigating this issue, the analysis of the viewpoints of the opponents of following of guesses (through investigating their reasons for forbidding the requirement of guesses and the inability to follow them along with discussing the abandonments due to this following) and the absolute proponents of this requirement (those who assume these reasons and abandonment as being illusion and resort to rejecting these requirements) are all taken into consideration. Dealing with the historical background and the variety of discussions leading to the development of viewpoints, in particular, in the proponents and accordingly to their categorization, the present study sheds light on the existing categories of abandonments due to following the guessed requirements, i.e., the arbitratorsrsquo harmony including both the opponentsrsquo and followersrsquo viewpoints and their rejection. It is obvious that clarifying these issues and the authority of the expansion approach can pave the way for raising discussions in other fields such as appearance, unified news and also for rejecting requirements for other indications such as analogy.
