درنگی در ماهیت تمکین با ابتنای بر انگاره مقاصد شریعت

وظایف و حقوق خانوداگی( از جمله تمکین زن) در نظام حقوقی اسلام، مبتنی بر هویت و ویژگی های تکوینی انسان(زن و مرد) است. این جُستار با روش توصیفی تحلیلی مبتنی بر منابع کتابخانه ای به ماهیت و ابعاد موضوع تمکین خاص و نسبت آن با مقاصد شریعت پرداخته است. برآمد بررسی احتمالات مختلف در مورد چیستی و ماهیت تمکین، گویای این است که تمکین، اقدامی در راستای رفع همه نیازهای جنسی و عاطفی و مجموعه ای فرآیندی و مرکب از اعمال و رفتارها(نه عملی لحظه ای و بسیط) است که سازنده عنوان استمتاع کامل می باشد. باور به این فرآیند و ترکب تمکین، به مثابه مقوِم استمرار خانواده با اهداف و مقاصد شریعت سازگارتر است و بلکه از سوی پذیرش بساطت آن با این مقصد مهم و شریف یعنی تحکیم بنیان خانواده ناسازگار است. این ادعا مستند به ادله و نصوص دینی مربوطه است. نگاه شریعت و فقه به خانواده و هر آنچه به استحکام به خانواده کمک می کند و همچنین تمکین را به مثابه جهاد در راه خداوند دانستن و سیاق روایات و اینکه روایات به ابعاد مختلف تمکین تام اشاره کرده اند، بخش دیگری از ادله ی ناظر به فرآیندی بودن است.

the duties and rights of the family (including the submission of the wife) in the islamic legal system are based on the identity and developmental characteristics of humans (male and female). this research، with a descriptive-analytical method based on library sources، has dealt with the nature and dimensions of the subject of special obedience and its relationship with the purposes of sharia. the result of investigating the different possibilities about the nature and nature of submission shows that submission is an action aimed at satisfying all sexual and emotional needs and a process and complex set of actions and behaviors (not a momentary and simple act) that constitutes the title of complete enjoyment.believing in this process and the combination of submission، as a factor of family continuity، is more compatible with the goals and purposes of the sharia، and it is incompatible with this important and honorable goal، which is to strengthen the foundation of the family، from the point of view of accepting its simplicity. this claim is based on evidence and relevant religious texts. sharia and jurisprudence look at the family and everything that helps to strengthen the family، as well as considering submission as a jihad in the way of god، and the context of the hadiths and the fact that the hadiths have pointed to different dimensions of complete submission، is another part of the evidence for the process.
