کارآمدی قاعده نفی سبیل در قانون اساسی با نگاهی به اندیشه امام خمینی (ره)

قانون اساسی مجموعه ای از قواعدحقوقی برتری است که سازماندهی قوای عمومی، وضعیت حقوقی حکومت کنندگان و روابط آنها با مردم و همچنین حدود روابط بین کشور و دیگر ملل را تعیین می کند. طبق قاعده عقلایی هیچ کشوری سلطه بیگانگان را بر نمی تابد . از کارآمدترین قواعد قاعده نفی سبیل است که تاثیر شگرفی بر نظام حقوقی ایران و قانون اساسی دارد .این قاعده اصول حاکم بر روابط مسلمین با کفار در عرصه ی بین الملل را تبیین می کند . لذا قوانین باید به گونه ای وضع شود که کفار بر مسلمانان تسلط نداشته باشند . امام خمینی (ره) کارآمدی این قاعده در تمامی روابط بین الملل ایران را واجب می دانستند. از آن جا که قانون اساسی ایران مولود اندیشه امام خمینی(ره) و تبلور عینی نگرش سیاسی و فقهی ایشان است سزاوار است که این قاعده در اندیشه امام خمینی (ره) و قانون اساسی بررسی شود تا در دو عرصه عملی و تئوری تاثیر این قاعده بنیادین مبرهن گردد. . ایشان با توجه به این قاعده ،روابط بین الملل ایران با دیگر کشورها ، با توجه به اسلامی بودن وکشورهای دارای سیاست استعمارگرانه قائل به تفصیل شده اند.

the constitution is the supreme legal rule that organizes the public forces، the status of the rulers and how to communicate with the ruled، as well as the boundaries and loopholes of the relations between the country and other nations. the law of the country blocks the way of domination. the rule of negating a mustache is one of the important rules that has a tremendous impact on international relations. the application of this rule explains the principles governing the relations between muslims and infidels in the domestic and international arena. they considered it necessary in all international relations. according to this rule، in the field of iran's international relations with other countries، they have given detailed attention to islamic countries and countries with colonialist policies. sometimes based on global unity and sometimes negation of any kind of tolerance in the field of application، the application and efficiency of this rule is clearly evident and emphasized in several principles of the constitution with different interpretations، which are explained in this research. also، in this research، the type of view and expression of imam khomeini (may allah be pleased with him) has been discussed. a group of people have considered this rule to be changeable according to the requirements of the time and even impractical and isolationist in the present era، while this rule has not blocked any contracts، but considers rational rules and regulations to govern those contracts.
