شیوه‌های جبران خسارت معنوی ناشی از نقص زیبایی خطای پزشکی

مسولیت مدنی و جبران خسارت معنوی از موضوعات مهمی است که همواره مورد توجه حقوقدانان بوده ‌است. جبران خسارت زیان‌دیده امری مهم، که قانون‌گذار به‌عنوان یک اصل توجه ویژه‌ای به آن داشته ‌است. از جمله مصادیق مهم و مصطلح از خسارت معنوی در جامعه امروز بحث نقص زیبایی است. به این معنی که شخص به دلایل متعدد، زیبایی ظاهری و چهره خود را ازدست می‌دهد و این امر سبب آسیب روحی و منزوی شدن فرد می‌گردد اما متفاوت بودن جبران خسارت معنوی و دشواری ارزیابی آن سبب نارسایی‌ها می‌شود. در این پژوهش با استفاده از روش توصیفی تحلیلی به شیوه‌های جبران خسارت معنوی پرداخته‌است که درنتیجه از بین روش‌هایی که جهت جبران خسارت معنوی ارائه شده می‌توان به شیوه های اعاده وضع به سابق، جبران معادل، نمادین و خسارت تنبیهی اشاره‌کرد. در این پژوهش بر ناکارامدی شیوه‌های جبران در نظام حقوقی ایران نتیجه‌گیری و توجه به خواسته زیان دیده در نحوه‌ی جبران خسارت تاکید و پیشنهاد گردیده‌است. به نظر می رسد با ارائه شیوه جدید بتوانیم سبب التیام و آرامش خاطر زیان‌دیده شویم، از این رو به هدف اصلی از جبران خسارت نائل شویم.

civil liability and compensation for moral damages are important issues that have always been considered by lawyers. compensation for damages of a damaged person is an important principle which a legislator should paid special attention. the issue of beauty defects is one of the important and common examples of moral damage in today's society. this means a person loses his/her appearance and beauty for various reasons, and this causes psychological damage and isolation. however, the difference in compensation for spiritual damage and the difficulty of its assessment causes inadequacies. to undertake this line of research, methods of compensation for moral damages have been addressed using the descriptive-analytical method. as a result, among the methods presented for compensation of the moral damages, the methods of restitutio in integrum, equivalent compensation, symbolic compensation, and punitive damages can be noted. the findings of the study reveal that the compensation methods in the iranian legal system is inefficient. therefore, attention has been proposed to the injured party in the method of compensation. it seems presenting a new methods can facilitate peace of mind for the damaged. thus, one may achieve the main goal of damage compensation.
