چالش‌های‌ نهاد قسامه؛ ‌امکان‌ و ‌امتناع‌ جایگزینی‌آن‌ در ‌حقوق ‌کیفری ‌ایران

یکی از ادله اثبات جرم در نظام کیفری ایران، قسامه است. با توجه به محدودیتهایی که استناد به قسامه را در جهت اثبات جنایت با مشکل مواجه می سازد، ارائه جایگزینی برای نهاد قسامه، امری ضروری به نظر می رسد. یکی از جایگزین هایی که می تواند نقشی همانند قسامه را ایفا نماید، امارات قضایی (ادله علمی) است که به دلیل پیشرفت علوم، جایگاه و اعتبار خاصی در میان سایر ادله اثبات دعوا دارد. دلایل فقهی نیز بر مشروعیت اماره قضایی گواهی می دهند و آن را یکی از راههای معتبر در اجرای عدالت می دانند. با توجه به حصری نبودن ادله اثبات امور کیفری، طریقیت داشتن ادله اثبات جرم در حق الناس به ویژه جنایت علیه تمامیت جسمانی اشخاص، پیشرفت علوم و فنون و وجود روش های علمی و دقیقی مانند انگشت نگاری، چهره نگاری، علم بیولوژی، رجوع به کارشناس و نظایر آن، می توان از امارات قضایی در مسیر دادرسی اثبات جنایت به عنوان جایگزین قسامه بهره برد. پژوهش حاضر با تکیه بر منابع متعبر فقهی، به دنبال تبیین این جایگزین است.

Challenges of the institution of oath; ‌ Possibility ‌ ‌ Refusal ‌ Replacement ‌ ‌ In ‌ Iran ‌ Criminal Law

One of the evidence of proving mass in the Iranian criminal system is several. Given the constraints that encounter problems in order to prove crime, providing an alternative to the institution seems vital. One of the alternatives that can play a role as several, is the Emirates of judiciary (scientific evidence), which due to the advancement of science, has a certain position among other evidences. Jurisprudential reasons are also certified by the legitimacy of the judiciary, and it is one of the valid ways in the implementation of justice. According to the notation of the proof of criminal proof, the evidence of proving crime in alNas, particularly the crime against the physical integrity of individuals, the advancement of science and techniques and the existence of scientific and accurate methods such as fingerprinting, faculty, biology, science, reference to the expert and likewise, the judicial emirate can be benefited from the proof of crime as an alternative. The present study relies on the sources of jurisprudence, seeks to explain this alternative.
