ماهیت و آثار رضایت زیان‌دیده در فقه امامیه و حقوق ایران

جایگاه مهم مسوولیت مدنی روز به روز در جوامع ملموس تر و حساس تر است که از سوی دیگر ارتباط قراردادها با نظم عمومی نیز سبب محدودیت های نیز شده است تاثیر رضایت زیاندیده در دعوای مسوولیت مدنی نیز علیرغم اینکه با رضایت حاصل می شود در جاهایی موثر و در جاهایی دیگر به جهت اینکه با نظم عمومی مخالف بوده موثر نیست ازاین رو شناخت دقیق رضایت زیاندیده قبل از ورود ضرر و پس از ورود ضرر از حیث تاثیر یا عدم تاثیر و شناخت چارچوب های نظری دیگر لازم و ضروری بنظر می رسد. از سوی دیگر رضایت زیان دیده با فرض کمال و صحت که در موارد ممنوعه قانونی نیز نباشد مورد پذیرش عقلاء و سیره عقلی و عرف قرار گرفته و با مبانی اصل حاکمیت اراده در حقوق و قاعده اذن مالک قابلیت انطباق را داشته است.

Therefore, the accurate cognition of the lost satisfaction before and after occurrence of the loss in terms of effect and lack of influence and understanding other theoretical frameworks seem to be essential. On the other hand, the satisfaction of the lost with the assumption of maturity and accuracy which is not prohibited by law is also accepted by the intellectuals, rational, and the custom and conforms to the basis of the principle of sovereignty, and the will be in the rights and norm of the owner permission
