تحلیل تاثیر تحول ساختار قدرت در خانواده بر حقوق زوج

ساختار قدرت در غالب خانواده‌های ایرانی از شکل اقتدارگرا (مرد‌سالاری) به نیمه دموکراتیک تحول یافتهو بدین‌ترتیب تمام ابعاد خانواده، خصوصا بعد حقوقی آن را از جهت حقوق اعضاء تحت تاثیر قرار داده است. یکی از مهمترین حقوق متاثر از تحول نیز، حقوق مربوط به زوج است. براین اساس در این پژوهش سعی نمودیمتاثیر تحول صورت گرفته را بر حقوق زوج بررسی نماییمو در این راستا به این نتیجه دست‌یافتیم، از‌‌آنجا‌که مقتضیات زمان و مکان، ضرورت انطباق قوانین با تحولات را ضروری می‌سازد، بنابراین قانونگذار نیز متناسب با تحول در ساختار قدرت در خانواده، به وضع قوانین جدید یا اصلاح قوانین سابق در خصوص حق ریاست، حق طلاق و حق تعدد زوجات اقدام نموده است. با این وجود همچنان اموری مرتبط با حقوق مذکور وجود دارند که تغییر یافته‌اند، ولی مورد توجه قانونگذار قرار نگرفته و درنتیجه خلاهای قانونی را در این زمینه به وجود آورده است؛ از این‌رو تغییر قوانین سابق یا وضع قوانین جدید، با استفاده از ظرفیت‌های فقهی در خصوص آن‌ها پیشنهاد می‌شود.

Analysis of the Influence of Evolution of Power Structure in Family on Husband’s Rights

Power structure in the most Iranian families has evolved from authoritarian (patriarchal) to semidemocratic. This transformation has affected all aspects of the family, especially its legal dimension, in terms of the rights of members. One of the most important rights under influence of evolution is husband’s rights. Therefore, in this research, we tried to examine the effect of the transformation on husband’s rights, and we concluded that since the requirements of time and place necessitate the necessity of adapting laws with developments, therefore the legislator appropriate to the evolution of the power structure in the family has introduced new laws or amended former laws regarding the right of presidency, the right of divorce and the right of polygamy. However, there are still  some affairs related to these rights that have changed, but have not attracted the attention by the legislator and, as a result, have created legal gaps; therefore, changes to previous laws or the establishment of new laws are recommended by using the legal capacity of them.
