جمهوریت و الزامات شکلی و محتوایی آن در نظام جمهوری اسلامی ایران

الگوی سیاسی مدنظر امام خمینی، رویکرد نسبتاً جدیدی در قلمرو «حکومت اسلامی» به شمار می‌رود. ایشان، حکومت مدنظر خود را به‌منزله «نوع» ی معرفی کرده که جمهوریت، «جنس» آن و اسلامیت، «فصل ممیز» آن از سایر جمهوری‌هاست. وقتی جمهوریت جزء ذات یک نظام سیاسی باشد باید انتظار داشت تا پیامدهای آن در تمام شئون پدیدار شود. بااین‌حال، در ادبیات سیاسی و حقوقی نمی‌توان به‌صورت دقیق، به تعریفی نظام‌مند از جمهوریت دست‌یافت. عدم وجود این تعریف موجب تعارض‌ ها و مناقشه‌ های مختلف در سطوح تصمیم‌گیری و اجرایی از جانبی و گفتمان‌های حاکم بر این امور، از جانب دیگر شده است. ازاین‌رو پژوهش موجود با روش تحلیلی-توصیفی و با توجه به قانون اساسی و سخنان امام خمینی در زمان معرفی ساختار مدنظرشان، در پی یافتن تعریفی از جمهوریت در نظام سیاسی جمهوری اسلامی و بررسی تاثیرات نظری و عملی آن است. برابر یافته‌های این مقاله، الگوی ارائه‌شده در جمهوری اسلامی ایران، ناظر بر ساختار شکلی و ماهوی جمهوریت است و در چهارچوب «کلان الگوی مدرن» قرار می‌گیرد؛ بنابراین مسئولان جمهوری اسلامی موظفند برای جلوگیری از دگردیسی و تغییر ماهیت، الزامات این امر را در تمام شئون لحاظ کنند.

the formal and substantive requirements of the republic in the system of the islamic republic of iran

imam khomeini’s political thought and model of state is a relatively new approach in the realm of islamic government. in this model, entitled islamic republic, the republic is a genus , and islam is the differentia from other kinds of republics. the importance of this point is that when the republic is the essensial part of a political system, one should expect its consequences to appear in all respects. however, in the political and legal literature, it is not possible to achieve a precise and comprehensive definition of the republic. the absence of this definition, causes various conflicts and disputes at the levels of decision-making and implementation on one hand, and the prevailing discourses on these matters on the other. adopting an analytical-descriptive method, this article aims to find a comprehensive definition of the republic in the political system of the islamic republic and to examine and analyze its theoretical and practical consequences. according to the findings of the article, the presented model in the islamic republic of iran is based on the formal and substantive structure of the republic and within the framework of modern great-approach accordingly, the islamic republic is obliged to consider the necessities of this matter in all its aspects to prevent metamorphosis and alteration of the nature of the government..
