پژوهشی پیرامون ولایت وصی در امر نکاح صغیر و صغیره با رویکردی بر آرای امام خمینی(ره)

مسئله‌ ولایت بر صغیر و صغیره، یکی از مسائل بسیار مهم در مبحث وصایت است. چنانچه پدر و جد پدری صغیر یا صغیره در قید حیات باشند، اختیار امور آن‌ها به دست پدر و یا جد پدری است و ولایت آن‌ها شرعی و قهری و از ناحیه‌ خداوند است. اگر موت پدر یا جد پدری نزدیک باشد، آن‌ها می‌توانند به کسی تحت عنوان وصی، وصیت نمایند تا امور صغیر و صغیره را بعد آن‌ها بر عهده بگیرد، اموری که ممکن است در ارتباط با صغیر یا صغیره مورد وصیت واقع شود، بحث مراقبت و تربیت او، اداره اموال، ازدواج و طلاق اوست. در این مقاله، نگارندگان با روش توصیفیتحلیلی و مراجعه به منابع کتابخانه ایاسنادی به بررسی ولایت داشتن وصی در امر نکاح صغیر و صغیره با رویکردی بر آرای امام خمینی و مشهور فقها پرداخته‌اند و پس از ذکر و بررسی ادله‌ قائلان به ولایت و عدم ولایت وی، برخلاف نظر امام خمینی که قائل به عدم ولایت وصی در تزویج صغار است، ولایت وصی در تزویج صغار را در صورت تصریح موصی ‌به اثبات رسانده‌اند.

the issue of guardianship of a minor boy or girl is one of the most important issuesin the field of will and testament. if the minors’ father and paternal grandfatherare alive, their authority is in the hands of the father or paternal grandfather, andtheir guardianship is based on sharia and divine law. if the death of the father orpaternal grandfather is imminent, they can appoint someone in their will to takecare of the affairs of the minors. the affairs that may be related to the minor boyor girl include their caretaking and upbringing management of their property,marriage and divorce.in this article, using descriptiveanalytical method andcollecting the necessary data from librarydocumentary sources, attempts havebeen made to examine the guardianship of the testamentary guardian regardingthe marriage of minor boy and minor girl an approach to imam khomeini andfamous jurists’ viewpoints. imam khomeini argues that the testamentary guardiandoes not enjoy the guardianship regarding the minor’s marriage. but, there areother jurisprudents who argue that if the testator explicitly mentions the issue ofthe minor’s marriage in his will, the testamentary guardian enjoys the right to getthe minors married.
