امکان سنجی حمایت تقنینی از بزه دیدگان تراجنسی در جرائم ناشی از نفرت با رویکردی بر دیدگاه های امام خمینی (ره)

جرم ناشی از نفرت به جرائمی اطلاق می‌شود که برخاسته از پیش‌داوری، تعصب یا نفرت نسبت به خصوصیات (موردحمایت) بزه‌دیده از قبیل نژاد، مذهب، ملیت، قومیت یا هویت جنسیتی باشند. یکی از ایرادات نظام کیفری ایران، فقدان سیاست جنایی تقنینی معین در قبال افراد تراجنسی است. در پژوهش حاضر پرسش اصلی آن است که آیا رفتارهای مجرمانه علیه افراد تراجنسی می‌تواند به‌عنوان گونه‌ای خاص از جرائم ناشی از نفرت در نظام کیفری کنونی شناسایی شود و در این صورت توجیه آن بر مبنای اندیشه امام خمینی چگونه است؟ بدین منظور تلاش شده است با روش توصیفی - تحلیلی  این موضوع با رویکردی بر اندیشه امام خمینی بررسی شود. در این رابطه سیره عملی امام خمینی تسامح صفر نسبت به تراجنسی‌ها نیست؛ بلکه رویکرد امام در اندیشه و عمل، حمایت حداکثری از تراجنسی‌ها و مساعدت در رفع موانع قانونی پیش روی آن‌هاست. این رویکرد حمایتی می‌تواند از تجویز فقهی-حقوقی تغییر جنسیت در تراجنسی‌ها تا حمایت از ایشان در مراحل پسابزه‌دیدگی تسری یابد؛ چراکه تراجنسی‌ها به‌نوعی بزه‌دیدگان بالقوه یا به تعبیری دقیق‌تر «بزه‌دیده پنهان» به‌حساب می‌آیند. درنتیجه می‌توان گونه‌ای سیاست جنایی افتراقی شامل حمایت کیفری تشدیدی (حمایت کیفری توام با کیفیات مشدده) در قبال این بزه‌دیدگان اعمال کرد.

Feasibility Study of Legislative Support of Transgender Victims in Hate Crimes with an Approach based on Imam Khomeini’s Views

Hate crime is a term attributed to the crimes resulting from prejudice or hatred on the basis of qualities (under support) such as race, religion, nationality, ethnicity, or sexual orientation. A fault with Iran’s penal code is this that it lacks a specified legislative criminal policy for the transgender individuals. In this paper, the principle question is whether criminal acts against transgender people can be identified as a certain type of hate crime in current penal system or not. If yes, how it can be justified based on Imam Khomeini’s thoughts? We have tried to analyze the issue with a descriptiveanalytical method with an approach based on Imam Khomeini’s views. In this connection, Imam Khomeini’s practical conduct is not zero tolerance toward transgender people; rather his approach, in word and action, entails maximum support of the transgender people and supporting any move to remove legal obstacles before them. Such supportive approach can be extended from jurisprudentiallegal prescription for gender transitioning in transgender people to supporting them in postvictimization period. This is because transgender people are counted among potential victims, or in more precise term, “hidden victims”. As a result, a sort of segregated criminal policy, including aggravating criminal support (criminal support along with aggravating circumstances) can be adopted toward these victims.
