ابعاد و صور تلازم حق و تکلیف در اسلام با رویکردی بر دیدگاه امام خمینی(س)

برخلاف تبلیغات مدعیان غربی دفاع از حقوق شهروندی که دین را فقط تکلیف محور، محدودیت آور و سلب‌کننده آزادی انسان معرفی می‌کنند، دین مبین اسلام نگاهی فراتر از نگاه بشری به حقوق و تکالیف شهروندی داشته و با جامع‌نگری و در نظر گرفتن ابعاد وجودی و نیازهای مادی و معنوی انسان، خلعت کرامت را تنها بر قامت او می‌پوشاند. بر این اساس، اسلام همه حقوق انسانی اعم از فردی و اجتماعی، مدنی و قضایی و فرهنگی، امنیت و آرامش، آسایش و رفاه همه مردم را تبیین و حدود و ثغوری برای آن‌ها تعیین کرده و به ازای حقوق، تکالیفی را به‌عنوان بایدها و نبایدها و احکام دینی مشخص نموده است. در این پژوهش با بررسی و تبیین ترابط و تلازمِ حق و تکلیف و ابعاد به هم‌پیوستگی آن دو در اسلام با استفاده از روش توصیفی تحلیلی، نتیجه حاصل می‌شود که دین اسلام بزرگ‌ترین حامی و واضع حقوق شهروندی است و وضع تکالیف و مجموعه بایدها و نبایدهای دینی برای تامین و حفظ حقوق انسانی بوده و ابعاد تلازم حق و تکلیف در آن از جامعیت کامل برخوردار است تا باعث عروج آدمی به مقام عالیه انسانی و معنوی و مشرف شدن او به مقام خلیفهاللهی گردد.

Dimensions and Forms of Necessity of Rights and Duties in Islam with Emphasis on Imam Khomeini’s Viewpoint

Unlike the propaganda by the Western thinkers claiming to support the bill of rights, who introduce religion as a dutybound, restricting, and antifreedom doctrine, the religion of Islam publicizes an approach to human rights and duties of the citizens far beyond the approaches by humans. Islam’s comprehensive approach toward existential aspects of man and his material and spiritual demands is the only doctrine that respects man. On this basis, Islam has clarified in full all human rights including social and individual, civil, judicial and cultural, security and welfare for all people with wellspecified limits, for which there are duties and responsibilities as musts and mustnots for Muslims to observe. In this research paper, we intend to review the cohesion of rights and duties and their intertwinement in Islam through a descriptiveanalytical method. This paper came to the conclusion that Islam is the major supporter and legislator of the bill of rights; still more, the cohesion of rights and responsibilities in Islam is so comprehensive and allembracing that helps man ascend to the peaks of humanity and spirituality to the rank of the ‘caliph of God on earth’.
