عدم مخالفت با کتاب و سنت ضامن صحت شرط و نفوذ آن در پرتو دیدگاه امام خمینی(س)

از اهم شروط نفوذ شرط و صحت آن، عدم مخالفت با کتاب و سنت است و این مهم به نحو موجبه جزئیه، حکم اجماعی و اتفاقی است که کسی از فقیهان در آن مناقشه‌ای ندارد. مستند این مطلب، نصوص عامه و خاصه‌ای است که دلالت بر اعتبار شرطی می‌کنند که موافق با کتاب باشد؛ یعنی مخالفتی با آن نداشته باشد. مراد از عدم مخالفت با کتاب، شامل سنت هم می‌شود؛ زیرا منظور از کتاب، مطلق حکم الله است چه در قرآن کریم باشد و چه در لسان سنت بیان‌شده باشد.بنابراین اگر شرطی مخالفت با کتاب نداشت، نافذ و در صورت مخالفت، این شرط غیر نافذ است و در صورت شک در مخالفت و عدم مخالفت،  شیخ انصاری قائل به اصل عدم مخالفت می‌شود؛ ولی بین محققین اختلافی وجود دارد که در بحث تمسک به عام در شبهات مصداقیه این مطلب روشن خواهد شد اگرچه بزرگانی چون امام خمینی در این مطلب به شیخ انصاری اشکال کرده و می‌گویند مجالی برای اصل عدم مخالفت نیست و در محل بحث، مجالی برای پیاده کردن اصل نخواهد بود. ثمره این بحث در فروع متعددی قابل‌رویت است ازجمله، اشتراط عدم خروج زوجه از وطنش، اشتراط ارث در عقد متعه، اشتراط ضمان در اجاره.

No Opposition to Book and Traditions, Prerequisite for Authenticity of Condition and Its Influence in View of Imam Khomeini

No objection to the Book of God and the traditions is one major prerequisite for the influence and authenticity of a condition. This is something confirmed in particular by a consensus rule and there is no debate on its authenticity on the part of the jurists. The solid evidence for this claim is the existence of general and particular texts that attest to the influence of a conditional case that is according to the Book of God, i.e. there is no objection to it. By objection to the Book, we also mean objection to the tradition. This is because the Book is the absolute rule of God, whether in the Holy Quran or in the traditions attributed to the Infallible Ones. Therefore, if a condition is not against the book, it shall be deemed influential, otherwise it shall be taken an invalid condition. In case of skepticism on the nature of objection, Sheikh Ansari has recommended interpreting it as a noobjection case. However, there is difference of opinions among the scholars on this point. They say it must be removed by resorting to the general consensus, although some jurists Like Imam Khomeini have found fault with Sheikh Ansari’s view and claim that there is no chance for the principle of no objection, and that, in case of any debate, there will be no chance for enforcement of the principle. This debate has resulted in a bunch of different opinions such as conditioning lack of exit of the spouse from the country, conditioning heritage in temporary marriage, and conditioning liability in rentals.
