رَهیافت آنارشیستی به ‌جرم‌انگاری

حقوق کیفری و جرم‌انگاری، عرصه‌ برخورد اقتدار دولتی و حقوق و آزادی‌های شهروندان است؛ نظریه‌های گوناگونی با پیش‌فرض ‌گرفتن مشروعیت اقتدار دولت، به‌عنوان نهاد پذیرفته‌شده برای وضع، اجرا و رسیدگی به ‌اجرای قانون و تَبَعاً تعریف جرم، تعیین مجازات و اِعمال آن، به همراه پیاده‌سازی نظام عدالت کیفری، در تبیین و توجیه جرم‌انگاری و کیفرگذاری مورد بررسی اندیشمندان این حوزه قرار گرفته است‌. توجه به ‌پدیدآیی مشکلاتی که این نگرش به‌ مساله جرم‌انگاری و کیفرگذاری ایجاد می‌نماید و نیز بررسی ‌تاملات فلسفی و جرم‌شناختی بیرون از دایره‌ پذیرش وجود دولت، با ملاحظه حق‌های اساسی شهروندان، لازم می‌آورَد که با نگاهی مبتنی بر اقتدارگریزی، با رویکردی آنارشیستی و مبتنی ‌بر نفی مفهوم دولت، به‌جرم‌انگاری نگاهی دوباره بیاندازیم؛ تا علاوه بر آن‌که دریابیم از این منظر اساساً جرم‌انگاری امکان‌پذیر نخواهد بود، بلکه لازم است برای تدبیر انحرافات اجتماعی از مکتب عدالت ترمیمی کمک بگیریم؛ ‌امری که به ‌نظر می‌رسد در فضای اقتدار دولتی راه به ‌جایی نمی‌برد؛ اما در فضای گریز از اقتدار می‌تواند راهگشا و اثربخش باشد.
