ارزیابی تاثیر جنسیت به عنوان متغیر فراقانونی بر آراء کیفری حوزه مواد مخدر (مطالعه موردی شهرستان کاشان)

باور عمومی آن است که قضات در مقام صدور حکم کاملاً تابع قانون هستند و به هیچ وجه از مولفه‌های فراتر از متن قانون همچون نژاد، جنسیت، مذهب، جوانی، تاهل و طبقه اجتماعی تاثیر نمی‌پذیرند، اما پاره‌ای مطالعات تجربی گویای آن است که در برخی موارد، قضات متاثر از این متغیرهای فراقانونی تعیین مجازات می‌کنند. پژوهش حاضر با تمرکز بر متغیر جنسیت در پرونده‌های مواد مخدر و در حوزه مطالعات جامعه‌شناسی حقوق کیفری به رشته تحریر درآمده و برای پاسخ به سوال‌های پژوهش، با اتخاذ روش پژوهش کیفی در حوزه قضایی شهرستان کاشان، بیست و سه پرونده را مورد مطالعه قرار داده و با نه قاضی و وکیل فعال در این حوزه، مصاحبه عمیق داشته است. یافته‌ها حاکی است که قضات در رسیدگی به جرائم مرتبط با مواد مخدر، خواه ‌ناخواه جنسیت مجرم را در راستای اِعمال نهادهای ارفاقی و تخفیف مجازات در قبال زنان، لحاظ می‌کنند که علت آن، تفاوت‌های جسمی و روحی میان زنان و مردان، قرار گرفتن زنان در موقعیت‌های نامناسب، تفاوت در انتظارات از زنان و مردان و همچنین عدم لزوم شدت عمل برای اصلاح مجرمان زن است.

evaluating the influence of gender as an extralegal variable on criminal judgements in the field of drug crimes (a case study of kashan city)

the general belief is that judges obey the law in sentencing and are not influenced by factors beyond the text of law such as race، gender، religion، youth، marital status، social class، etc.، but some empirical studies prove that in some cases، judges determine punishments affected by these extra-legal variables. the current research was written focusing on the gender variable in the drug cases and in the field of sociology of criminal law. in order to answer the research questions by adopting the qualitative research method in the jurisdiction of kashan city، twenty three cases were studied and had in-depth interviews with nine judges and lawyers in this area. the findings indicate that judges، whether they want to or not، take into account the sex of the criminal in dealing with the drug crimes to apply the institutions of reduction and reduce the punishment for women، which according to the interviewees، could be the physical and mental differences between men and women، placing women in inappropriate situations، the difference in expectations between men and women، as well as the lack of need for strict action to correct female criminals.
