هرمنوتیک و ارزش‌گذاری قضایی نقاشی‌های پست‌مدرن در حقوق مالکیت فکری

یکی از جدیدترین چالش‌های فراگیر در حقوق مالکیت ادبی و هنری، ارزش‌گذاری بر روی نقاشی‌های پست‌مدرن می‌باشد. این آثار به علت فقدان قواعد خاص، نداشتن سبکی واحد، تناقض‌آمیز و شالوده‌شکن بودن و در نتیجه فردی شدن ماهیت کاملاً متمایزی نسبت به نقاشی‌های سنتی و مدرن پیدا کرده‌اند؛ به‌گونه‌ای که تا امروز معیار مشخصی برای ارزش‌گذاری بر روی این آثار ذکر نشده است. از آنجا که این آثار ممکن است آوردۀ شرکت تجاری واقع بشوند و یا مورد رهن‌گذاری قرار گیرند و یا در مواردی موجب ایجاد مسئولیت مدنی واقع گردند بالقوه می‌تواند موضوع ارزش‌گذاری آن‌ها اهمیت قضایی مضاعف پیدا کند. در این مقاله با توجه به روش علم هرمنوتیک و زیبایی‌شناسی، به ارائۀ معیارهایی جامع و مانع برای چگونگی ارزش‌گذاری بر روی نقاشی‌های پست‌مدرن پرداخته شده است تا با روش علم هرمونتیک به‌عنوان خادم تحقیقات قضایی هدف عدالت رویه‌ای را در این دعاوی تضمین نماید. نتیجۀ تمرکز بر اصول یافته تفسیر هرمونتیکی درخصوص گرامر هنر پست‌مدرن و تاکید بر شخصیت ذهنی نگارنده می‌تواند تبدیل این مفهوم کیفی به روش‌های کمی ارزش‌گذاری اقتصادی را تامین نماید.
