اصول و الزامات حقوقی حاکم بر فناوری‌های حقوقی دادرسی قضایی

رفتارهای اجتماعی به‌عنوان موضوع علم حقوق از مهم‌ترین موضوعاتی است که با ظهور فناوری‌های جدید تحت تاثیر قرار گرفته است. در سال‌های اخیر، فناوری‌های حقوقی سعی نموده‌اند دسترسی عمومی به عدالت را افزایش دهند. این فناوری‌ها بر سه دسته اَعمال دادرسی قضایی دولت، خدمات حقوقی قضایی خصوصی و اقدامات تنظیم‌گر دولت اثر می‌گذارند. توسعۀ فناوری‌های حقوقی مانند هر پدیدۀ حقوقی دیگر نیازمند برنامه‌ریزی در مسیر و منطبق با مبانی نظام حقوقی است. عدم توجه به تناسب فناوری‌های حقوقی به‌کار گرفته شده در دادرسی قضایی با نظامات حقوقی حاکم بر آن، باعث می‌شود که فناوری‌های حقوقی وارداتی این حوزه نیز دچار تجربه‌ای مشابه فناوری‌هایی شوند که نه تنها موجب تسهیل و تقویت کیفیت اعمال سابق نگردیده، بلکه مشکلات بدتر و غیرقابل جبرانی را نیز به همراه داشته‌اند. در این مقاله با روش تحلیلی توصیفی سعی گردیده است با بررسی اصول دادرسی عادلانه، به الزامات نظام حقوقی جمهوری اسلامی ایران بر فناوری‌های حقوقی دادرسی قضایی دست یابیم.

Legal principles and requirements of judicial proceedings’ legaltech

Social behavior as a subject of law is one of the most important issues that has been affected by the emergence of new technologies. In recent years, legal technologies (LegalTech) have been tried to increase public access to justice. These technologies affect three categories of judicial proceedings, private legal services, and government regulatory actions. Develope LegalTechs, like any other legal phenomenon, requires programing in the direction and in accordance with the principles of the legal system. Inattention to the relevance of legal systems governing and the LegalTechs that used in judicial proceedings, causes similar experience for LegalTechs, like imported technologies that not only did not facilitate and strengthen the quality of previous practices, but worse and irreparable problems. Have also been accompanied. In this article , we have tried to achieve the requirements of the legal system of the Islamic Republic of Iran on the judicial proceedings’ LegalTechs by examining the principles of fair trial by analyticaldescriptive method.
