تاثیرات متقابل آرای حقوقی و کیفری؛ از تئوری تا رویۀ قضایی

تاثیرات متقابل آرای حقوقی و کیفری بر هم یکی از موضوعات مهم پرونده‌های حقوقی و کیفری است. بنا بر نظر مشهور، محکمۀ حقوقی مکلف به‌تبعیت از رای قطعی دادگاه کیفری است و در صورت رسیدگی هم‌زمان، دادگاه حقوقی را مکلف به توقف رسیدگی می‏دانند. هرچند دقیقاً همین رویه در تبعیت دادگاه کیفری از رای حقوقی قطعی وجود دارد و این قاعده مختص دادگاه کیفری نمی‌باشد. چنانچه هر کدام از محاکم قضایی حقوقی و کیفری رسیدگی‌کننده حسب مورد، بدون اعتنا به آرای دادگاه دیگر که رای آن در پروندۀ تحت‌نظر موثر است، مبادرت به صدور رای نماید، تاثیرات نامطلوبی ازجمله صدور آرای متناقض و غیرقابل‌اجرا بر جای خواهد گذاشت که در این خصوص می‌بایست اصول، مبانی و شرایط تاثیرات متقابل آرای حقوقی و کیفری بر هم به خوبی مورد بحث و بررسی قرار گیرد و مطالعۀ دقیق رویۀ قضایی در این خصوص می‌تواند در ارائۀ راه حل مطلوب موثر باشد. در مقالۀ حاضر ضمن بررسی و توجه به رویۀ قضایی متهافت، جایگاه قاعدۀ تبعیت دادگاه حقوقی از رای قطعی کیفری و حالت عکس آن در نظام حقوقی ایران و ارتباط رای دادگاه کیفری با نظم عمومی مورد بررسی قرار می‌گیرد و در نهایت رویۀ قضایی شاخص و مبنای حقوقی دقیق منطبق با موازین قضایی ارائه می‌گردد. روش تحقیق کاملاً تحلیلی، کاربردی و عملی است. حاصل نتیجۀ تحقیق این است که کیفری یا حقوقی بودن موضوع، ملاک برتری و تبعیت از دیگری نمی‌باشد، بلکه پروندۀ مقدم، اعم از اینکه کیفری باشد یا حقوقی، برای سایر مراجعی که بعداً رسیدگی می‌کنند، لازم‌الاتباع است.

Upon view of some judges and doctrine of the legal court is bound to follow the final vote of the penal court and in case of simultaneous proceedings , the legal court is bound to cease the proceedings. If each of the legal and penal judicial court proceeding vote , upon the case, without consideration to the other court’s votes , its vote is effective in the related case, there are adverse effects such as contradictory and unenforceable effects and accurate study of the judiciary proceeding in this regard is effective in representing of favorable solution. This article, while studying and consideration to the judiciary procedure has being become a position of dependency rule the legal court from penal definite vote in Legal law of Iran and a legal base of the mentioned rule such as validity rule of a competed affair and communication of the vote of the penal court with public discipline and dimensions, limit of rule and its judicial documentaries was investigated and finally the indicator judiciary proceeding and presentation of a base of an accurate law has been represented according to the judiciary rules.
