تعامل استاندارد حمایت کامل و امنیت (fps) با استثناء بهداشت عمومی در حقوق سرمایه‌گذاری بین‌المللی با تاکید بر کووید19

ساماندهی رابطۀ میان استاندارد حمایت کامل و امنیت (fps) و بهداشت عمومی یکی از چالش‌های دیرینه در حقوق سرمایه‌گذاری بین‌المللی است. چه آنکه پاسداشت بدون ضابطۀ بهداشت عمومی از سوی دولت میزبان، امکان ایجاد آسیب برای سرمایه‌گذاری خارجی، و حمایت مطلق از سرمایه‌گذاری خارجی، احتمال از بین رفتن منافع عمومی و اساسی کشور میزبان به‌دنبال دارد؛ در این نوشتار کوشش شده است که نظام حقوقی حاکم بر این موضوع در حقوق سرمایه‌گذاری بین‌المللی مورد بررسی قرار بگیرد. اینکه دولت‌های میزبان چگونه می‌توانند ضمن پاسداشت بهداشت عمومی، از نقض استاندارد حمایت کامل و امنیت (fps)، و ایجاد مسئولیت بین‌المللی برای خود، جلوگیری نمایند، مسئلۀ اصلی مقاله است. این مطالعه نشان می‌دهد که حقوق سرمایه‌گذاری بین‌المللی در ساماندهی رابطۀ میان حفظ بهداشت عمومی، و اجرای استاندارد یاد شده، نه‌تنها رویکرد روشن و مشخصی ندارد، بلکه در برخی موارد دچار یک رویۀ متناقض گشته‌ است. به‌عنوان مثال، با آنکه مبارزه با کووید19، به‌عنوان یکی از مصادیق بهداشت عمومی از طریق برقراری قرنطینه، ایجاد محدودیت‌ها و تعیین ممنوعیت‌ها، ذیل حق حاکمیتی کشور میزبان به‌رسمیت می‌شناسد، اما در این حالت ممکن است که برای آن‌ها مسئولیت بین‌المللی داشته باشد.

Interaction of the Full protection and Security Standard (FPS) with the public health exception within the body of the international investment law with emphasis on Covid-19.

AbstractBalancing the relationship between The Full protection and Security Standard (FPS) and the public health is one of the oldest challenges within the body of the international investment laws; since the protection of public health, without regulating the host countries, leaves room for harm to foreign investment, and the strict protection of foreign investment, can lead to the losing the public and fundamental interests of the host country.Therefore, within the current paper, there is an attempt to examine the legal system that overrules these concerns within the body of the international investment laws.The question which remains is how can host countries maintain their public health whithout breach of the Full Protection and Security Standard, and Creating their international responsibilities.This study shows that, the international investment laws do not take a clear stance when it comes to regulating the relationship between public health, and the implementation of (FPS), and that they are in fact in some cases paradoxical and disorganize .For example, although the fight against Covid19, as an example of public health through quarantine, restrictions and bans, Recognizes the right of sovereignty of the host country, it may also have an international responsibility for them.
