تاملی بر معیارها و مرجع تشخیص باغ در رویۀ دیوان عدالت اداری

عموماً آراء دیوان در ارتباط با عنوان مالکانۀ «باغ»، حول محورِ شناسایی مرجع صالح برای تشخیص آن صادر شده است. در این خصوص، با تصویب «قانون اصلاح لایحۀ قانونی حفظ و گسترش فضای سبز در شهرها» در سال 1388 و تشکیل «کمیسیون مادۀ 7»، رویۀ ناصواب دیوان در شناسایی «کمیسیون مادۀ 12 قانون زمین شهری» به عنوان مرجع صالح برای تشخیص باغ اصلاح گردید. در مقابل و به دلیل برداشت‌های نادرست از قوانین حاکم، یکی از مسائلی که در نگاه قضات دیوان مغفول واقع شده است، توجه به ویژگی‌ها و ماهیت «باغ» بوده است. در متن حاضر، به بررسی رویه‌های متفاوت و گاه متهافت دیوان در خصوص مسائل فوق اشاره شده است. هم‌چنین، ماهیت «کمیسیون مادۀ 7» و تصمیمات آن به‌منظور شناسایی نهاد ناظر بر آن‌ها و نیز، مرجع تصمیم‌گیرنده در خصوص تغییر کاربری باغات، موضوعات دیگری‌ هستند که در کنار شناسایی مرجع صالح به تشخیص باغات، دغدغۀ اصلیِ مقالۀ حاضر را شکل داده‌اند.

Thoughts on the Criteria and competent authority of garden identification in the administrative court of justice procedure

Most of judgements of the administrative court of justice in relation to the title of & garden& have been issued about the identifying a competent authority for its recognition. In this regard, after the enactment of the law on the reform of the law on the conservation and development of greenbelt in cities in 2009 and the formation of the &Article 7 commission&, the court’s inappropriate procedure in identifying the &article 12 commission of the landurban law& as a competent authority for recognition the garden was refurbished. In contrast, and because of misinterpretations of the governing laws, one of the issues that have overlooked by the judges was the attention to characteristics of the &garden& and its nature. The present text deals with the court’s different and sometimes divergent procedures on the above issues. Also, the nature of article 7 commission and its decisions to identify the competent authority to overseeing them, as well as the decisionmaking authority for changing the use of gardens, are other issues besides identifying the competent authority to identify the garden, that form the main concern of this article.
