مبانی حق انسان بر بدن خویش؛ بیان نظریۀ کار و طرح نظریۀ بدن برای بدن

در حال حاضر پیوند عضو یکی از روش‌های مهم درمان بیماری‌ها است؛ مطابق اعتقادات اولیۀ بشر، بدن تنها یک مجموعۀ محترم و دارای ماهیتی رمزآلود است؛ اما همراه با پیشرفت‌های علمی، انسان اهمیت بدن و اعضای آن را به‌منظور استفاده‌ در طرح‌های تحقیقی و عملیات‌های پزشکی دریافت؛ ازاین‌رو شناسایی رابطۀ انسان با بدن خویش تبدیل به یک مسئلۀ مهم گردید؛ شناسایی حق تصرف برای انسان در بدن خویش به‌منظور جلوگیری از هدررفت اعضای بدن، انگیزۀ عمدۀ نظریه‌پردازان در حوزۀ مطالعات راجع به رابطۀ انسان با بدن خویش است؛ اما بحث راجع به مالکیت انسان نسبت به بدن خویش همیشه با چالش‌های اخلاقی، مذهبی و فرهنگی همراه بوده است؛ از این رهگذر نظریاتی مانند نظریۀ کار در حقوق غربی مطرح شده است؛ در پژوهش حاضر نظریۀ بدن برای بدن با هدف رفع ایرادات و جبران کمبودهای نظریۀ کار برای نخستین بار ارائه می‌گردد؛ مطابق نظریۀ بدن برای بدن، استفاده از بدن انسان جزئی ضروری برای تحقیقات در حوزۀ سلامت است و این ضرورت امری کاملاً جدید است و نبود سابقۀ تاریخی حاکی از تصرف انسان در بدن خویش، نمی‌تواند نافی چنین حقی در زمان حاضر باشد؛ چراکه مبنای معرفت بشر نسل به نسل تغییر می‌کند؛ بنابرابن عقل بی‌زمان وجود ندارد و آنچه دیروز ضرورتی نداشته است، می‌تواند امروز ضروری باشد. این تحقیق از نظر هدف، کاربردی و از نظر نوع، کیفی و از لحاظ نحوۀ گردآوری‌ داده‌ها کتابخانه‌ای و مبتنی بر مطالعۀ منابع برخط است.
