سیاست کیفری ایران در قبال تغییر کاربری اراضی زراعی و باغ‌ها

تغییر بی‌رویۀ کاربری اراضی کشاورزی یکی از چالش‌های مهم بخش کشاورزی ایران است. تغییر کاربری اراضی، سالیانه بخش عمده‌ای از اراضی باغی و زراعی را از چرخۀ تولید خارج می‌کند. قانون‌گذار تاکنون رویۀ ثابتی را برای مقابله با این بزه به کار نبسته است و مقررات این حوزه دستخوش تغییر و تحول بوده است، به‌نحوی که می‌توان دهۀ 70 را دورۀ تدبیر و ترسیم، دهۀ 80 را دورۀ تغییر و تنظیم و دهۀ 90 را دورۀ تضعیف و تخریب سیاست کیفری مربوط به حفظ کاربری اراضی زراعی و باغ‌ها دانست. تحلیل بزه تغییر کاربری اراضی زراعی و باغ‌ها و بررسی نقاط قوت و ضعف قانون‌گذاری در کنار توجه به رویۀ قضایی به‌نوبۀ خود می‌تواند، چالش‌ها و خلاهای موجود را آشکار سازد. در این مقاله به بررسی ارکان این بزه و تفسیرهای قابل‌ارائه پیرامون استثنائات تغییر کاربری خواهیم پرداخت. پس از آن با توجه به تغییرات قانون مجازات اسلامی مصوب 1392 در درجه‌بندی جرائم و تعیین مواعد مرور زمان با موشکافی در ماهیت «قلع‌و‌قمع» به پاسخ این پرسش خواهیم پرداخت که آیا این اقدام مجازات محسوب می‌شود یا خیر؟ با توجه به مبنا و موضوع انتخابی روش نگارش این پژوهش توصیفی‌تحلیلی است و در گردآوری داده‌ها از روش کتابخانه‌ای استفاده شده است.

Changing the use of agricultural lands and orchards in Iranian criminal law

Currently, the change of agricultural lands is one of the important challenges of Iran’s agricultural sector. Land use change annually removes a large part of agricultural land from the production cycle. The legislature has not yet adopted a consistent approach to deal with this crime, so that the 70s can be considered a period of deliberation and drawing, the 80s a period of change and regulation, and the 90s a period of weakening and destroying penal policy to preserve agricultural land use. And he knew the gardens.Land use change analysis and examining the strengths and weaknesses of legislation, along with paying attention to the proper judicial procedure, can reveal the existing challenges and gaps. In this article, I will analyze the elements of this offense and the possible interpretations of exceptions to land use change in an analytical manner. Then, according to the changes in the Islamic Penal Code adopted in 1392 in grading crimes and setting deadlines, we will answer the question of whether this action is considered a punishment or not by scrutinizing the nature of &tin and repression&. According to the selected basis and subject, the writing method of this research is descriptiveanalytical and library data has been used in data collection.
