توسعۀ صلاحیت نسبی ناشی از ارتباط دعاوی در ایران و فرانسه با نگاهی به رویۀ قضایی

مقررات صلاحیت جلوه‌ای از ادارۀ شایستۀ دادرسی و به‌طور کلی حکمرانی خوب است. مقررات صلاحیت بر پایۀ مقررات اولیه و ثانویۀ صلاحیت تنظیم می‌شود. در مقررات اولیۀ صلاحیت، چهارچوب کلی و اولیۀ ضوابطِ تعیین و تشخیص صلاحیت ارائه می‌شود. اما اعمال این مقررات به‌تنهایی نمی‌تواند هدفی را که از مقررات صلاحیت دنبال می‌شود، برآورده کند و لذا صرفاً با به‌کار‌بستن این مقررات، صلاحیت موثر و مناسب و کامل به ‌دست نمی‌آید. از همین‌ رو، مقررات ثانویۀ صلاحیت وارد عمل می‌شود. ارتباط دعاوی، یکی از مقررات ثانویۀ صلاحیت می‌باشد که بر صلاحیت نسبی اثر می‌گذارد و موجب می‌شود که صلاحیت دادگاه عالی توسعه یابد. در آیین دادرسی مدنی فرانسه، نحوۀ توسعۀ صلاحیت نسبی با ایران متفاوت است که در این پژوهش مورد مداقه قرار گرفته است. در مادۀ 21 قانون شورای حل اختلاف ایران، توسعۀ صلاحیت نسبی مرتبط با نظم عمومی است و دادرس نیز می‌تواند ایراد ارتباط وارد کند و نیز برخلاف آیین دادرسی مدنی فرانسه، در حقوق ایران اینکه دعوا علیه یک شخص باشد یا اشخاص متعدد و نیز دعاوی متعدد مرتبط هنگام دادخواست مطرح شود یا در حین رسیدگی، موثر در توسعۀ صلاحیت نسبی نیست.

Extending the Relative Jurisdiction Arising from Connectivity of Claims in Iran & France by Reviewing the Judicial Process

The rules of jurisdiction are regulated based on primary and secondary provisions. In primary rules of jurisdiction, the general framework for determining competence criteria is presented but the application of these regulations alone cannot meet the purpose pursued by the rules of jurisdiction. Therefore, by virtue of the application of these regulations, effective and appropriate competence will not be obtained; for this reason, secondary rules of jurisdiction play a critical role. Connectivity of claims is one of the secondary regulations of jurisdiction which will be affected by the relative jurisdiction and eventually lead to the development of the jurisdiction of the Supreme Court. In the French civil procedure, the relative jurisdiction of development is different from that of Iran. The focus of this research is that “What are the effects of connectivity of claims on relative jurisdiction in civil procedure of both Iran and France?”, “What are the exclusions of the primary jurisdiction rules”?
