تاثیر عدم رعایت اصول مهم دادرسی بر بی اعتباری رای دادگاه

در نظام قانونی آیین دادرسی کیفری فعلی با وجود آنکه سال‌هاست اهمیت قوانین شکلی در حد قوانین ماهوی دانسته می‌شود، قانون‌گذار هنوز نپذیرفته است که این دو نوع قانون اهمیت یکسانی دارند. بر مبنای این عدم پذیرش، نقض قوانین ماهوی همواره موجب بی‌اعتباری رای دادگاه است؛ اما نقض قواعد شکلی تنها در صورتی که به درجه‌ای از اهمیت باشد که موجب بی‏اعتباری رای شود، می‏تواند موجب نقض رای گردد. اما سوال این است که این تشریفات با درجۀ اهمیت بالا کدامند؟ معیار‌های گوناگونی می‌توان برای تشخیص این تشریفات تصور کرد. معیاری که بر اساس آن تشریفات، با درجۀ اهمیت بالا محسوب می‌شود که نقض آن‌ها موجب نقض یک قانون ماهوی است، معیاری است که با متن قانون فعلی و قوانین سابق بیشتر تطبیق دارد؛ اما معیاری که بر اساس آن تشریفات با درجۀ اهمیت بالا همان اصول بنیادین دادرسی‌اند، با اهداف آیین دادرسی کیفری مطابقت بیشتری دارد.
