جایگاه مراجع خاص اقلیت‌های دینی در حقوق ایران و آثار تصمیمات آن‌ها

یکی از نوآوری‌های قانون جدید حمایت خانواده در مادۀ 4 این قانون و در رابطه با مراجع اقلیت‌های دینی مشاهده می‌شود. در رابطه با صلاحیت این مراجع و ارتباط آن‌ها با محاکم قضایی می‌توان گفت، اشارۀ قانون‌گذار به مراجع خاص اقلیت‌های دینی به معنای نفی صلاحیت دادگاه‌های عمومی در رسیدگی به امور اقلیت‌ها بر مبنای قواعد و عادات مسلمۀ متداولۀ دین و مذهب متبوع آنان است. علاوه بر این، با توجه به اینکه این مراجع صلاحیت رسیدگی به احوال شخصیه و امور حسبی اقلیت‌های دینی را دارند و در قانون به رسمیت شناخته شده‌اند، می‌توان آن‌ها را با کمی اغماض، جزوی از نهاد قضاوتی قضایی از نوع استثنایی دانست که تصمیماتشان در دادگاه معتبر است و تا زمانی که مخالفتی با نظم عمومی و اخلاق حسنه نداشته باشد، تنفیذ و اجرا خواهد شد.

Certain Authorities of Religious Minorities in Iran’s Act and theEffects of Their DecisionsOne the innovations in the new act of family support is observed in article 4 for the authorities of religiousminorities. Concerning the competence of these authorities and their relationships with the judicial courts,legislators deny the competence of the general courts in hearing the minority affairs based on their religiouscommonalities and certain rules and habits. Moreover, given that these authorities are competent to hear thepersonal status and nonlitigious affairs of the religious minorities and are legally recognized to do so, they canbe, to some extent, considered as an exceptional part of the judicial judgment institution.
